ELD Needed for Non CDL 24' Box Truck Going Interstate?

    I am driving a Non CDL 24' Box Truck down the west coast interstate ... Do I need to run an ELD? Now just a heads up: I AM going to run an ELD -- but the question is more under to understand trucking regulations then it is to instruct what I am going to do. Thank you!

    Two separate questions need to be answered:

    1). Are you subject to DOT HOS? If yes, are your required to carry a log book?

    2). If yes, are you subject to ELD requirements? That is, you are NOT an exempt carrier, NOR an exempt commodity, NOR an exempt vehicle, AND you are subject to DOT HOS more than 8 days out of the last 30.

    Accidental Trucker -- Okay, I understand the 2nd part about log books versus ELD. But unclear on the 1rst part. Is it true that if a driver without a CDL license is driving a non-CDL 24' interstate then he wouldn't need to use a log book. But if a CDL driver were driving a non-CDL 24' then he WOULD need to use a log book. Is that correct?

    No. Neither the length of the vehicle, nor the license status of the driver determine the need. For Federal DOT purposes, any vehicle with a GVWR over 10K used in interstate transportation for commercial purposes is subject to DOT rules. That means the driver is subject to the HOS regulations, and needs a valid medical card (EVEN IF HE DOESN'T HAVE A CDL!), driver qualification file, etc.. The vehicle and the carrier are ALSO subject to federal DOT rules, i.e. DOT #, annual inspection, maintenance program, etc.

    Generally 'Non-CDL' commercial vehicles are exempt inside the 150 air mile radius, as long as they follow the requirement to return and terminate at their starting 'work reporting' location within the prescribed time period.

    From Central NJ we could reach south eastern Rhode Island...of course our one and only Non-CDL guy went about 20 miles too far and we got caught for a bunch of Part 395 violations.
