    This shows you just how diverse our country is when it comes to law enforcement. LOL

    Come to my hometown, and I'll introduce you to the Officer who will write you a ticket, then be Judge and jury.

    And he won't do it on the side of the road. This will actually take place in 1 of 2 locations, the county Court House, Or City Hall. Depending on where the citation was issued, and what the charges were.

    Believe it or not. I like this "local" method, and the Presiding officer. He's very fair.

    In other MS counties.....not so good LOL

    LMAO... well what can I say.

    Actually, our Chief of Police has jurisdiction within the city limits AND the county. He holds 2 seperate offices. COP and JP. Elected to BOTH for a second time just last month.

    I was concerned about our most recent election. He had some big names and big money gunning for him. But he won easily.

    I grew up with this guy, and consider him to be one of the most honest people I know. And he doesn't play favorites. He's perfectly happy locking the Mayor up, as he is grabbing the local crackhead.

    Which IMHO is exactly why they tried so hard to have him removed :D

    CHILL IF YOU WILL, ALL I WAS TRYING TO DO WAS GET TO THE BONES OF THE MATTER. YOU ARE ABSOLUTELY RIGHT I AM FIRST TO ADMIT I DO NOT KNOW THE RULES, BUT IN INTERPERTATION COMES THE TRUTH.... I HAVE LEARNED THE TRUTH,BUT IN AN ATTEMPT TO DO SO I HAVE MADE THE NATIVES RESTLESS!! WHAT A GREAT ACCLOMPLISHMENT TO HAVE LEARNED AND KNOW THE BOOK!! BUT AS A CONFIRMNATIN AS I STATED EARLIER ,IF THIS BOOK IS BROUGHT OUT AND EVEN A QUESTION IS ASK. IT IS AUTOMATICALLY A INSULT TO ANY OFFICER AND IT WILL PISS THEM OFF!! AND JUST AS YOU SAID "WILL NIT PICK YOU,AND GO THROUGH YOUR TRUCK W/A FINE TOOTH COMB..     Noun1.presiding officer - the leader of a group meeting leader - a person who rules or guides or inspires others

    moderator - someone who presides over a forum or debate

    moderator - in the Presbyterian church, the officer who presides over a synod or general assembly

    chairman, chairperson, chairwoman, chair, president - the officer who presides at the meetings of an organization; "address your remarks to the chairperson"

    Speaker - the presiding officer of a deliberative assembly; "the leader of the majority party is the Speaker of the House of Representatives"

    OK, I looked it up, and to show I am a fair person, I am sharing it with you:biggrin_25525:

    As I said before, "presiding officer" does not jibe in this scenario. An LEO, on the scene for traffic infraction, vehicle inspection, or scale house, is not "presiding officer". There is not a "group" as a "presiding judge" is in charge of a group forum or debate (which is what a court trial would be..two sides arguing the points of their debate and the "presiding officer" (the judge) deciding which side has more merit or points of law), the officer on the roadside is an individual, sworn to uphold and protect the laws of the land.

    No problem Harley G, after your log is examined and you're cited for failing to have your log up-to date you can catch it up to the inspection time. If any falsifications are discovered you'll be cited for that as well.

    Drivers often ask what's the best method to log.... The answer? As you drive it.



    In order to get to the preciding judge you first deal with the preciding officer. Semantics? Sure. But in order to see the preciding judge you have to travel to the court's jurisdiction, i.e. Red Bluff, CA; probably take a day off work and then depending on your defense still pay the penalty.

    If you fail to appear in court you may have your CDL suspended for a FTA (failure to appear).

    I have witnessed a time or two when officers made mistakes; however, arguing on the roadisde is not the forum. Carriers are allowed to do a "DataQ" challenge at www.safersys.org if the carrier can provide sufficent evidence to have the violation dropped from the MCSAP inspection the driver has a better chance in having the charges dropped in court.

    PSA: I guess I was a DOT agent too...I used to run dozers, dumps, and the big gang mowers on the interstate for the Virginia Dept. of Transportation!

    I liked Tater's description of conduct before a LEO. Best one I've seen yet.

    Thanks, as a rule I prefer to be smarter then what Im working with if possible. Not better educated just "smarter".
