Exception???? log book entry

    Well, at least in a cherry picker on the side of the road with a laser a state officer wouldn't be head on and at a decent angle where the laser would work. The early ones didn't work unless it was pointed from an angle. Directly in front or back & they would give false readings. The batteries must work a lot longer now as well.

    Could we get some input from you guys Dieselbear & PSanderson.

    I know what the "answer" is. But I'm curious how it would be handled, if a driver attempted to apply the letter of the law, to an inspection or roadside stop.

    Scenerio --- Roadside stop and inspection.

    Driver is pulled over for mudflap missing. Officer has decided to do quick Level 3 inspection.

    At the drivers door, the officer notices the driver is quickly drawing a line in his log book. Then places it on the dash, and rolls down the window.

    Upon inspection, the log book reflects off duty and the line has been drawn down, but no location has been written on the line. The time is current.

    Where would this go from this point? I won't offer an arguement, as I'm sure you know what it would be. But I am curious about your answer.

    Been there done that no problems. I also have a good attitude with leo's instead of being mr richard cranium as well. Guess it could go either way.

    Reminds me of one I've wondered about. Ga. law supposedly states that the troopers have to be visible for 500yds. to be a legal speed stop. If true, then the cherry picker route is obviously not in concurrence, as the cop is in hiding. I'm not sure if it's true for Ga. or any other states and have always wondered about it, seeing cops just over the rise of hills waiting for targets.

    He wouldn't be off-duty because being pulled over is line 4. In addition the driver couldn't have been driving and off duty either. either would be a violation of 395.8 (false RDS).

    I have seen all too many RDS's where a single driver has ended yesterday in one location, and began the next day in a different location 300 miles away. How did that transpire without driving?

    Assuming your statement is correct Re. visibility, are you suggesting that a cherry picker is not visible for 500 yards, 2-miles worth of warning signs and all?

    You'd truly be surprised. All too many drivers think that is the norm until they get caught, especially newer drivers who haven't figured it out yet but think they have.

    For that scenario, I do not get worked up for that. I can work with the guys I stop. I get them to make it current. Depending on their attitude I will put it as a violation. I usually don't issue a citation for it, unless I catch them in a false log. Be surprised how many false logs we find on a daily basis. Like PSanderson stated, we see a lot of dumb s h _ t on the side of the road.
