    I got paid percentage at my last company. But we made good money.
    Also the company took out all taxes ect, not 1099.
    If you cannot say how that truck is run, what loads you do or do not want ect, then you cannot use a 1099. That is how the IRS sees it.
    I have seen Lease OPs at several larger companys lease a second truck then pay the driver they hire for it on 1099. But the driver they hire is an employee. So leagaly they cannot go under 1099. The person hireing them and leaseing the truck will eventually get cought. And both of you will be in a sling for not fileing correctly.
    Also, if the truck in question is leased to a carrier, many of them are only getting like 90 or so cpm + FSC to the truck. The driver in this case will (or should) get 35% of the 90 CPM, which is not that good a rate, considering they still have to pay tax, ssc, and personel unemployment.
    They would end up making only like 28 cpm by the time they pay other than personel taxes, and would take home what any starting driver does if they are lucky.

    In the expediter forum a guy was talking about being 1099'ed and not owning the truck. Yet they expected him to buy fuel and no reimbursement. :rolleyes:
