Not sure if you are correct. I failed three times trying to pass the pretrip, skills, and drive. After that the state required I retake the written exam. This is because you get three tries for each permit issued for a written exam.
Failed road test. Only have one more try. Demoralized right now

There is a misconception that if you fail a few times, then you are not going to get a CDL at all.
This is where the company may be the problem, they are counting the "failed" test as a failure when it shouldn't be. Even if the OP takes another round of written tests (they are easy so it shouldn't be an issue), and the company foots the bill, then takes the road test again, that would justify the BS he went through.
If the company doesn't accommodate the OP due to the examiners behavior, then they may be in breech of their contract and he is owed money for the course or what ever he paid.MBAngel Thanks this.
