So what I'm hearing here is that it's OK in your eyes to be jailed for disorderly conduct have your rig towed, and get fired that way rather than obey a lawful direction? And before anyone tells me I'm full of ######, here;s the actual law in my state...
I wonder where you're coming from here... I'm not trying to be a smartalec, but even "Captains of their own ships" have to follow the direction of proper enforcement authority. And as a Licensed Master Mariner (Ship Captain) I have a bit of knowledge regarding tnat statement as well.
One can argue the words "breach of the peace" till the cows come home, but it gets convictions each and every day.

Within reason! That doesn't give you permission to hit things. The cop doesn't know how to operate a truck.
capfiremedic Thanks this. -
I'll give you that condo.
But you know how hotheaded and badge heavy some of these youngsters are... And they're getting away with it.
BTW, on a Mississippi uniform accident report, if you're listed as "vehicle 1", you're the one believed at fault. -
Maybe in MS thats what would happen to you, but highly unlikely given these specific circumstances (go forward and run over a vehicle). I think the court would use the "what a reasonable person would do" train of thought. IF and only IF this scenario went down as stated, which I (and I would say) OTHER "reasonable" folks here at TTR are finding this story suspect. But, for the sake of the hook, lets say it is...........
A company should report this type of incident on a persons DAC report. Negligence speaks to a persons judgement, even more so when the outcome is so obvious. In this case there are lots of things that could have been done to avoid this! Examples?????
1) Call dispatch, operations, someone!
2) Ask the officer to contact the person (officer)
supervising the shift to come to the scene.
3) Call a wrecker yourself.
4) Don't move until its safe to do so!
There are more (feel free to chime in). The point is, there ar numerous choices better than damaging a car. What's most troubling is that the OP seems to think he was somehow "wronged" in this situation, when in fact he is 100% culpable.
But heres the thing, I believe he hit a car and missed appointments, the order from the police......um, well, really?
sorry, Im jaded from the bs excuses from drivers while I worked for USA truck.capfiremedic Thanks this. -
