Driver mistake, but sounds like it should have just been a "Form & Manner" violation, not an OOS.

    MHC and NavigatorWife Thank this.

Per PDF file copy of ticket: OR

Yes, driver is in violation and if driver has been doing it this way forever and a day, someone needs to take driver and show him/her the proper way to fill out a log and be in compliance. BTW, you do not have to fill out a DVIR (driver vehicle inspection report) UNLESS there is a defect on the vehicle. That is the current law anyway...for now LOL

    Federal Register / Vol. 79, No. 243 / Thursday, December 18, 2014 / Rules and Regulations 75437

    49 CFR Parts 392 and 396

    ACTION: Final rule.

SUMMARY: FMCSA rescinds the requirement that commercial motor vehicle (CMV) drivers operating in interstate commerce, except drivers of passenger-carrying CMVs, submit, and motor carriers retain, DVIRs when the driver has neither found nor been made aware of any vehicle defects or deficiencies. This rule also harmonizes the pre- and post-trip inspection lists. It responds in part to the President’s January 2011 Regulatory Review and Reform initiative, removing a significant information collection burden without adversely impacting safety. The Agency also makes a technical change to § 396.11 to eliminate redundant language.

DATES: This final rule is effective December 18, 2014.

All logbook errors are drivers' mistake..BTW he signed his name to 3-16 (under the penalty of perjury) that everything logged for that day was true and correct and certified by him, then he went and drew up a new page for 3-16 saying he went on -duty..that is a bit more than a mistake..

It's an insignificant Form & Manner error, nothing more. Or at least, that's how it should be treated.

    MHC and NavigatorWife Thank this.
