Fight it or Pay it?

    Tell him to read FMCSA 383.51.

    If he gets convicted of a speeding fine of over 15 mph of the speed limit, the second time is a suspension of 60 days.

    It pays to always try to get the ticket reduced or to non moving violation.

    The trooper also gave him a sheet that he has to give to his company for them to sign and mail it back to them with in 15 days, and it also go's on a record for DOT so when they pull him over again it shows where and what he was doing.

    He said it was so his compay knows he was speeding.

    That's right, I forgot about that. So it's worth it for him to go to court and even try to get it knocked down to 14 over.

    I would really be interested in the form he got. There is no law requiring notification of being pulled over for speeding to be given to an employer. Only convictions.

    It would lead me to believe he may have been given a dot inspection along with the ticket. Maybe a level 3, log book, medical card and license. Those do require the sheet and signature.

    He did say it was a DOT trooper that did pull him over. He also said that he also told me that his log book was straight and the trooper handed it back to him.

    He told me that CT and NY troopers have you sign a yellow form, give you a copy and then tell you to have your company sign and send it back. And he told me it was for the speeding and not any other truck/log violations.

    Any NY or CT drivers that can confirm this?

    for some reason it now looks like this trooper had it in for him because if he didn't have it in for him he could have wrote him for 64 in a 50 making it under the 15 mpg law.
