Then it sets a precedence in law. Once that happens expect to be destroyed in court if something ever happens to you and you had a minor log or truck issue.
Finding drivers, it is the easy part but ...

There used to be an LTL trucking company, pretty big on the east coast called G.O.D. trucking.
Their schtick was "Guaranteed Overnight Delivery"
One of their drivers pulled several bonehead moves in front of a friend who was leased to the same company i was.
He followed the driver to his terminal and walked in to and asked to see the safety manager.
Explained exactly what the guy had done, no cameras back in that era.
The safety guy brought the driver in while my buddy waited, the driver in question didn't deny anything.
Reviewed his work record on the computer, read the driver the riot act and suspended him pending further investigation.bryan21384 and silverspur Thank this. -
In this case, no.
But I can think of several that should’ve went out the window as soon as they landed in a judge’s hand. There’s the McDonald’s coffee lawsuit. I recall one against Winnebago from some idiot who “cruise control” was somehow synonymous with “auto pilot”. And more to the topic at hand there was one I read about here with a guy in Georgia who was asleep in his house when some drunk plowed through his fence into his yard and was killed when he hit the driver’s truck.
From what @AModelCat says I gather this sort of frivolous bottom feeding BS doesn’t fly north of the border.bryan21384, RockinChair, Big Road Skateboard and 1 other person Thank this. -
Part of the issue here is what kind of cost can you impose on a massive carrier thats large enough that it forces them to be proactive?
47 million easily kills up to a 50 truck carrier, but scneider? They posted 31 million profit for q4 2023 alone... (yes q4 is usually most profitable by volume, but...) extrapolating thats 124 million PROFIT for a single year, in which they were down close to 90% profit from the previous year.
So 47/124= only 38% OF their profit for a crappy year...

I’m not saying that BS lawsuit don’t exist. Because they certainly do. I just took it to mean he thinks this one is. And well I can’t agree with that. They got 47 mill from SNI because SNI had 47 mil. If it would have been a small company they wouldn’t have gotten that. You notice the other company's insurance settled long before the lawsuit.bryan21384 Thanks this.

Mcdonalds lady had 3rd degree burns (*error*had to have multiple skin grafts *error*)all across her groin area, and her INITIAL ask was for mcdonalds to just cover her medical bills, when push came to shove, they had been told repeatedly to not go that hot by governmental agencies whom they had ignored for a few years.

Coffee is hot. But some places really do need to dial back the thermostat a bitbryan21384 Thanks this.

The issue in the McDonald's lawsuit is that the plaintiff showed McDonald's had received numerous complaints going back years that their coffee was much too hot and was causing burns, and they continued to ignore it.
