Fired for accident

Sadly the way insurance is set up you always need to take a piece of the negligent driver with you .

 

Unfortunately in the wonderful world of truck driving, you’re screwed if you do and you’re screwed if you don’t.

To the bean counters sitting behind the desk, they think there’s always a different way it could’ve been handled.

Move forward and quit dwelling on the past, they’re not the only trucking company in the world.

If you were given unemployment it means you weren’t at fault.

Unfortunately companies can terminate your employment for any reason, and that just happened to be the catalyst.

 

I don’t mean to be harsh but without evidence of the other truck causing your actions ( dash cam would be great in this instance) you just had a damage caused incident. Sorry for your bad luck.

 

i would first admit that you have owner ship in this matter too. i feel your post points the finger at everyone else but you. learn from this and do better. good luck

 

I agree with @Dale thompson.

In your next, and better position, use a dash cam to help record things around you.

We can all say "always hold your lane", but until we're put into that position it's hard to say what we'll do.
The natural thing, especially for a newer driver, was to steer away from the sideswipe.
Unfortunately, it caused a bigger problem and allowed the REAL Culprit to ease away into the night.
Had he just sideswiped you the damage would have been minimal, and there would be a better chance that you would still be employed because Reasonable Doubt as to cause comes into play with another vehicle listed in the accident report.
The dash cam really would have helped here, too. A LOT.

You've got to pick yourself up and move forward.
Use it as a learning experience.
The longer you do this, the more you'll be aware of your surroundings and potential hazards.

Go get another position.

Unfortunately it is a "he said, she said" situation. Remember, get a piece of negligent driver, is the way it has to be done. Trade paint. When its all said and done, and your sitting on the side, or laying in the median, and they went on their merry way..not good..for you.

2nd. YOU'RE are fault here.
It seems counter intuitive, but HOLD THE LANE AND TAKE THE HIT.
Get that other truck involved. PROVE they were the reason for the accident.

 

Maybe she's defensive at this point after a lot of finger-pointing and blame.

But I half-agree with this. The entirety of OP's post is on everyone else.

 

He was in his lane. That is the type of B S you get from the office. The lane holds one truck not two. I for one will never hit a jersey barrier or go into a ditch because of a dumb driver that cannot control his lane. I personally would hold my lane and if need be crash into said a hole and let the cops figure it out. The other driver could be over hours or drugged up. My logs will reflect I am sober and clean. I always use the smith system and am a pretty good judge of character when one of these guys are coming up on me. I actually put my trailer on the zipper to force him out a little so as to avoid such problems.
