Fired for drinking off duty while on the road?

    what if it was a double edge sword, and the newbie was a well experienced undercover employee, making sure the mentor/trainer was on the up and up..???

    or a plant from some safety company Swift hired for such an undercover operation..???

    I called Swift's safety dept to get the truth. Turns out the OP once moved the truck one minute before his 30 minute break was over. The HOS are meant to save lives, you might as well murder someone if you don't take the full 30.

    But seriously long story short, op got caught doing the dirty, their hands are dirty, and swift used some soap. End of story, really. I mean I know that's blunt, and yes we could have a whole conversation about it. But it's the same logic when four wheelers get a ticket doing what everyone else does. But everyone else is doing it! So, I caught you.

    That's not an "exception". That is yet another "guidance statement". The point is any LE or company snitch can interpret the section anyway they choose. "Off Duty Status"??? How many times have we been told "you can not be in a truck sleeper without being in "Sleeper" status? Which might be interpreted differently than "Off Duty" by some LE.

    All I'm saying is ... you're not going to drink a beer in your truck while another company driver or CMV cops doing inspections across the way can see you.

    These "guidance" statements are meaningless in reality. They need to rewrite the regs. Until then, you are pushing your luck if you decide to test the limits or your personal interpretation.

    quite a few years ago, my (then) elderly dad, fell and hit his head on the house steam radiator...gave himself quite a gash.

    we have a sordid sense of humor in my family..

    i told the ER doc ( a gal), that since it's Halloween (when this happened), to add more stitches to make him look scary...


    my dad's response to that...??

    "my son, funny huh"...???

    doc said, "this family is weird"........

    Yeah I'm sure an undercover "plant" is going to drive a truck otr while the guy their supposed to be investigating is sleeping, farting and playing video games. Why would you waste your time writing something like that.
