Not really. The guidance is really just clarification. Yes it's not the law, but the law does state "(3) Be on duty or operate a commercial motor vehicle while the driver possesses ....."

So yes, off duty use in the cab is specifically not regulated.

With that on your DAC it’s unlikely you will be hired elsewhere. Not being melodramatic but that particular mark on your DAC is a death sentence. My advice: find another gig quickly (there are plenty of them) or you’ll stew on this and get bitter.

Always is ... Talk to that Swift security office to get what was left out. Doesn't matter the guy admitted to drinking AND having alcohol on a commercial vehicle. Would have been fired anyway you look at it.

What a mix ... Alcohol and commercial driving ... And BRINGING it into a commercial vehicle. If your that bright you should not be a CDL holder , never again.

So a driver has a drink today and then operates a vehicle tomorrow dead sober has a problem?

Look at PAM Transport's headquarters in Tontitown, AR..... Right next door is the Red Door Bar. There's a path from the dorms to the front door of that place, adults can drink and still operate commercial vehicles alcohol and drug free.
