The Driver is responsible for the tractor/trailer no matter if a O/O or company driver. The Driver will be held accountable if someone dies for a overlooked issue that could have been fixed and caused the accident.

If you have to spend time in the shop for maintenance issues then you spent time in the shop. You simply let your DM know.

When I drove I put all issues as minor or major. Major - I did not move, but right to the shop. Minor issues that can be held off till you hit the yard again.

Proper pre-trips, even if it means taking the time to go over every cranny and every nook.
With these CSA scores being the bane of everyones existence, passing random inspections means alot more to me than getting to a pickup or delivery on-time.
And seeing how broke some states are, like Crapifornia, they'll take their extra time to find the slightest thing you missed and shut you down over it.

Personally, I feel more comfortable driving in areas where I don't have to be eye-balled.
But unfortunately, things never run that way.

On the Engine part, I was a company driver, but I paid for a truck wash out of pocket to keep the truck clean and the engine clean. Easier to spot leaks that way..

    just my .02.

    By who's definition?

Other than a Fatal accident; the driver must be cited AND there be medical treatment required awy from the scene -or- disabling damage requiring a tow...

    No ticket = No test

During a drug and alcohol training course the instructor clarified what the driver and carrier need to do.

The driver must remain 'available' for testing until the time prohibitions [8hrs & 32 hrs] expire. If the LEO decide to isue a ticket within that time frame you are still required to test. More than 8 hours later and it's just the drug screen and it there is a citation after 32 hours the carrier must recoprd why testing wasn't performed and leve it at that.

The instructor went thru a bunch of 'What if' scenarios and his bottom line was to never test someone 'just in case'. Supposed you do this and it comes back hot BUT the police don't issue a citation.

You can't use the information; all the driver needs to do is call the MRO and say that his Post Acident test was not required.

The MRO cannot test outside the law and the test will be voided.

How do you put this guy back to work?

The 'positive' Non Test is not grounds for a reasonable suspicion test.

This is a 'Catch 22' situation I never want to be in!
