    As far as I know, the requirement of speaking English is for interacting with police, inspectors, and other emergency personnel.

    I don't know where your figure of 57 million comes from, so I won't address that.

    And no, I'm not wild about more immigrants entering the country based upon what I see of the current bunch.

    There’s absolutely no hypocrisy. You and others just don’t understand the reality of the rule or its history.

    Aside from what I’ve included..being unable to speak English was never a oos violation. It was simply a violation that was added to an inspection report that the carrier had to rectify. Enrollment in English classes was one way to satisfy the violation and I imagine firing the driver was another.

    These threads are sounding more like a bunch of women on a never ending pms cycle..


    In the ANPRM, the FHWA stated that § 391.11(b)(2), as promulgated by the former Interstate Commerce Commission (ICC) in 1936, was intended to be enforced through the motor carrier employer. As noted in the ANPRM, the ICC specifically stated that it was the motor carrier employer’s responsibility to evaluate the driver’s proficiency in the English language. In addition, FHWA noted that the regulation was not intended to be enforced at the roadside. The employer was presumed to know what communication skills may be necessary for the type of cargo handled, the route taken, and the public contact required. The FHWA went on to say that it had never made speaking the English language a specific pre-requisite for obtaining a Commercial Driver License (CDL), and in fact proposed, and later authorized, administration of the CDL test in foreign languages.”

    Lol, imagine that, this issue goes back to 1936 and all of a sudden it’s now 100% hysteria!

    For all the ones that aren't bothered by the lack of english speaking foreigners driving 18’s that would change when one much like the Austin debacle last week plows into your family and as they sit in the mangled mess dead the guy walks around like nothing bad happened and its just another day at the office. Then he will be basically let off the hook because of the race and religion thing and support from the fringe community that protects their own, who in your beliefs secretly support without really even realizing it.

    Find the old rule books and you will see it was a requirement of employment. The Icc would shut down a company if a driver or drivers could not communicate. One of the things the original teamsters made sure of. Fmcsa did not exist back then and when they came along after deregulation many past written rules of the Icc were left out of the new regs. They in accence changed many of those rules overnight. Generations have passed and they were lost in the ether. The old rulebooks can be thrown in the trash to keep the new generations from seeing them. Cdl’s didn't exist until fmsca came along yet they will make you believe it had been required since 1936 also.

    I posted facts and backed them up…you should also.

    Please also post facts that the accident in Austin was caused by a driver that didn’t speak English.
    Also to believe that the driver is going to be let off the hook is pure nonsense.

    There are lots of old timers on this site who drive for years without cdl before the fmsca created it that can tell you the same thing. Icc was very controlling during regulation and english was one of them. If you couldn't speak you worked the docks or maybe local in the districts of your own people but you never got free reign to drive across the country. Never could dare to leave your state.
    As for the guy getting off easy. He is no longer in the news. Wonder why? The foreigner fringe community has already stood up for his behalf down here. Crazy the power they have. Remember the cuban Colorado mountain crusader is getting out of prison next year for what he did. Why is that? That is getting off pretty darn easy in my book. Not totally scott free but very easy. Bet he will have a cdl again pretty quickly too. Easy to do with the right connections with the cartels.

    More nonsense.
    He’s sitting in jail and according to the affidavit he understood and spoke English. I know it blows a giant hole in mantra but that’s the way it is.
    The irony of the op if anyone stops to think about it..

    Amazon is now facing a couple huge lawsuits now..One’s that I hope they lose with a nuclear verdict. They better hope that they vetted the carrier well.
    Yet Texas now wants to limit these awards, and the fans cheer it. You can’t make this crap up..let’s protect the companies who invite this type of low intellect drivers.

    His company either had too many violations or was shut down by fmcsa.
    He tried opening up another authority under a relative or friends name and got caught.

    Fmcsa has smartened up and can easily trace these frauds by the fleet vin numbers.

    These are the same clowns buying used MC numbers on TTR.

    Glad to hear that they caught up to one of them.

    Funny you tube has already pulled the cell phone video of the driver walking around like no big deal after the crash and when being confronted about what happened not one word of english came out his mouth and you can tell he had no clue of what the words being spoke to him really meant. Even an english speaking stoned drunk cant pull that off. Local News now got ahold of it and clipped into the narrative bits it needs.
