Forced to break 34 hr rule

    No! You are wrong. You are not "supposed" to have a 34 hr restart after working 70 hrs. Can you? Yes. That is 1 option and if your company wants you to do this, ok. But there is another option of just recapping your hrs. Add up your hours from today going back 7 days. Subtract that total from 70. The answer is how many hours you will have available for tomorrow. Do that every day and, depending on the hours you worked each day the previous week, you could work every day never doing a 34. Truckers did this from 1939 to Jan 2004.

    Here's some math about a couple of different ways to run for long periods of time without being in violation:
    1. Working 8.75 hours/day. Never run out of hours on your 70. Allows about 500 miles a day at 60mph, 15 min for pretrip, 15 min for fuel. Allows 15,000 miles in 30 days without ever taking a 34 hour reset. Legally.
    2. Maxing out drive time every day and resetting. Drive 11 hours, 15 min for pretrip, 15 min for fuel. Allows about 660 miles a day at 60mph. Hit 69 hours around supper time day 6, start 34 hour reset. Start fresh 70 around 5 am on day 8. Requires a 34 hour reset every week, so you lose 6 days running each month. Allows 15,840 miles in 30 days. Also legally.

    (Note: the above examples assume US HOS. Canada allows 70 in 7, which would up your daily work average to 10 hrs/day)

    If you want to work every day but not be worn out and don't particularly like hanging around truck stops, method 1 is the way to go. It also adds the flexibility to run harder earlier if you need to. If you like sitting around truck stops for 6 days every month and only gain 840 miles for it, method 2 is the way to go. In my opinion, many dispatchers would rather see a driver who runs consistently every day and always has hours than someone who sprints from point to point and runs out of hours every week.

    Anybody who says you MUST take a 34 reset after reaching 70 is completely clueless. The recap is your friend.

    This statement right here shows me you have no idea how to recap. You said he had 2 hours left. So he wouldn't be on violation "right away". Sounds like the boss knows how to recap and doesn't think a 34 is necessary. Of course without seeing your friends recap we won't know for sure.

    in the very beginning of the thread it was mentioned the friend had been out 4 days and was at 68 hours
    so a lot of not knowing is going on

    HMCSA Regulation is; 11/14/70, you can drive up to 11 hours with in 14 hour, once you hit the 11 hour of driving you can not drive again until you take a 10 hour break, you are only allowed to accumulate 70 hours in 8 days, the only way to get a full 70 is to take 34 hours off, you do not have to take a 34, you can work off your recap, for example; day 1: 9:45, day 2: 8:15, day 3: 9:00 day 4: 7:30 day 5: 9:45 days 6: 9:30 day 7: 9:15 day 8: 8:45, this is a total of 62.25 hours, leaving 7.75, the next day, day 9, you would add the hours from day 1, 9:45 + 7:45 equals 17.5 hours, the 168 hour rule, and the 1-5 twice rule has been suspended, you log works on a rolling week, every day, ad the previous 7 days, and that's what's available for that day

    I had a guy who has been "Driving 31 years" tell me the other day that you cant use the 34 hr restart anymore because they did away with it.............:biggrin_25513: We share the roads with these ####tards.
