I sincerely hope that your case can be heard in a court of law and a fair outcome is reached. That being said, I don't think it helps your situation to rant and rave about all the legal details on an open social media platform. If you were wronged by this company, as you say you were, then I wish you the best. Let your legal representative handle the details rather than sharing them with the world before a legal judgment can be made.

I was found to be 100% disabled from this injury and will not ever be able to drive again after a 34-year career! Oh, and I had long term disability insurance with forward air! And they also have refused to give me my benefits that I am supposed to get. I have been fighting for 4 years for those benefits also! Thirty days after being hurt, forward air's contractor relations manager called me and stated he had investigated the whole accident. Knew the trailer I was hurt off and verified everything. He then stated they were willing to pay me 25K if I would sign a paper that I would come back to work in 3 months. Well, that wasn't accepted how could I when the doctor's had just stated it would take up to a year for my vertebrate to heal. Now, listen carefully... Have fun trying to find a lawyer that will take a case in Greene County Tn. There is NO ONLINE FILING OF CASES WITHIN THE COURT THERE! So, if you do find a lawyer, he will have to drive to file a case. And I will tell you now, you will not find a lawyer! No lawyers will take cases there due to conflicts of interest, too far to travel and believe me the list goes on and on. I lost a 34-year career, my home, cars, tractor-trailer and everything due to a split second while trying to roll down a stupid door on one of their trailers! Forward air's headquarters is Greenville, TN and they have employed for generations people from the area. Even if you ever did get a trial, it wouldn't be fair, and you would lose! I am just warning all drivers! Yes, you make good money with forward air BUT don't get hurt or in an accident. READ THE CONTRACT CAREFULLY!!!!! FORWARD AIR WASHES THEIR HANDS IN ALL LEGAL SITUTATIONS THAT YOU MAY GET INTO AND YOU ARE HELD 100% LIABLE. After what I have been through to this date and reading all the fine print. Thank-god I never was in a truck accident with this company, you will be on your own! So, long story short.... Is the money, your career, your life worth driving for this company? If you say yes, good luck with your choice!

First I am sorry that this happened to you. Unfortunately when you are a contractor you don't have the same benefits when you get injured. The type of workmans comp is not the same and may have limitations. I would keep trying to find an attorney, because in my opinion that were negligent by not repairing the door. I was presented a similar document at my hiring stipulating that I would only file a tort claim in the county of the company’s headquarters. I declined to sign. I have no intention to ever having to file a lawsuit but why would I voluntarily agree to tie my hands regarding venue?

It's called Premise Liability suit and also suit against the long term disability insurance company. 2 different suits! I was hurt on their property, their trailer and their employee (dock worker) who not only damaged the door but totally went against company policies of flagging, telling or doing nothing but just left the trailer in the condition it was. Yes, legally you can sue for this. I became 100% disabled due to this trailer being still put in service after having damage done to it. It's not my fault at all.

workman comp cases can go on and on, i KNOW that as a fact.

i been thru w/c claims at least twice in my life.

i got hurt in different states, and an attorney here in MY state represented me, as he got each case transferred here....

again...this is fact.

if you are a private contractor, didn't you have your own workman's comp insurance..???

sorry you got hurt, that sucks, but it happens, and just cuz it happened to YOU at that company, does not mean everyone else is going to get hurt.

1 more thing, there are cameras all over the places these days...

it is highly possible that a camera "caught you" closing that door improperly....but more importantly,,, you stated this:

why didn't YOU report that damage 1st..???

to me, once you knew it was damaged and you took it, it's on you all day long and twice on Sundays

I was ordered to pick up the trailer from their terminal right out of the dock doors! All I did was try to put down the door! As for camera's or any other type of stuff like that. Forward air destroyed all evidence of such. They also stated on court documents that the "have no knowledge to every question asked" Knowing full well they do know the questions.. But, as far as the trailer I hitched to it, pulled it out, tried to close the door, and afterward had to put it back into the dock door. I wasn't going to take a trailer down the road with the roll down door that only would shut half way.

EVEN LAWYERS HATE IT, BUT ONLY 1 YEAR FROM DATE OF INJURY OR YOU CAN NOT FILE ANY LEGAL SUIT AGAINST THEM!! SO DON'T THINK YOUR GOVERNED UNDER YOUR STATE RULES WHEN IN ORDER TO FILE ANY SUIT AGAINST FORWARD AIR. IT ONLY CAN BE FILED IN GREENE COUNTY, TENNESSEE AND YOUR LAWYER WILL HAVE TO PHYSICALLY DRIVE TO THE COURT HOUSE IN ORDER TO FILE! THERE IS NO ONLINE FILING OF CASES IN GREENE COUNTY TENNESSEE! FOR all those who have asked.... Yes you break a vertebrate straight across you can be disabled for the rest of your life! Yes, it can heal but can take up to a year to do so! And if healed like mine did, WEDGED, and where it pushes the vertebrate toward your spinal cord there is NO surgery that can ever be performed! I was under the care of the best spine center in New England and there is NO surgery to fix it. If in fact, I ever slip, fall on ice or anything I could become paralyzed from my waist down. It's not a joke and it could happen to you! But, my story is just the hard cold facts of what Forward Air has done to me and what I have been thru! I seriously want everyone to heed my warning! It's true you make good money with Forward Air but in a split second you could lose everything as I have!
