Re reading it, it looks as if the bunk heater didnt work and he chose not to idle due to low fuel, i would have idled it till it died. Company picks the fuel stops? Then its their problem if i dont have emergency fuel for idling. Once it died, i would inform dispatch that the truck is dead, im taking a cab to the nearest ts. The truck is locked. Have the hook pick me up at the ts.....

Refused truck?I'm pretty sure the heater went out sometime after he got the trk.

Chances are this driver was new and didn't know what to do in cases like this.Me I would have waited maybe an hour then call dispatch every 15 minutes wondering where brkdown is and tell dispatch I'm bobtailing to the truck stop call me when brkdown is on their way.I also would have asked for the shops number and wondering how long it's going to be.You have to take into consideration Transam was probably his first company.

Btw, why would i have to concider the fact that it was his first job? What does that change? Nothing. #### company, did a ####ty thing to a know nothing driver. Happens everyday, most times your telling people to nut up and walk away, but here your on the side of suing...

When I read the actual court records, the driver missed his fuel stop, pulled onto the side of the road and then discovered he could not move. His claim of being below empty and not having heat seems suspicious, using the excuse that the bunk heater or apu didn't work doesn't make sense when he decided to go back into the sleeper to sleep until the repair truck got there instead of sitting in the cab and running the truck for heat. No mention of the heater of the truck being defective or not able to produce enough heat to keep it above freezing.
