I was in the top 5% of drivers of the company that fired me the first week of Nov.last year.I ran 140,000 mi.from Jan.to Nov.I earned every quarterly fuel and safety bonus usually 600.00 or more. They also gave me a year end bonus of 1500.00 which helped until my unemployment kicked in.
Then I started putting in applications all over town and in other towns and was being turned down even by companies that was hiring rookies.I have over 4 million miles without a DOT accident.Twenty five years pulling flats, oversize, tankers, ten years pulling dry vans and reefers.
The only regret I have is getting into this business 35 years ago.
This is pretty much what I told the young lady that interviewed me at the SS office.

Our township did not drive Wal-Mart out. We simply did not let them in. We're lucky to have voted in a Board of Supervisors who actually listen to their constituents.
I don't shop Wal-Mart, either.Jimbo60 Thanks this. -
I have a bad feeling that this story is going to play out All over the country When csa 2010 Goes into full effect!
I m afraid That we are seeing the tip of the iceberg here! As more and more recommendations From the asinine medical review board Become a regulation, More drivers will become disqualified And unemployed! So that they can be replaced by cheaper, foreign labor.
You don't have to agree with me now, And i truly hope that i am wrong, But let's see what happens in the next 3 to 5 years. -
Your dossier seems to be quite impressive. It appears your claim is you were fired because of your weight. I cannot say for sure since I have no first-hand knowledge of your situation. What I will say, though, is that Prime is one of those companies who will not hire anyone with a BMI over 39, which will be the standard set forth by CSA2010. That would be 310 lb for a man 6'2".
However, there are numerous drivers currently working for Prime who well exceed the 39 BMI threshold. These drivers are not being relieved of their duties. They are being requested to take a sleep apnea study to see whether they are apnic. If it turns out they are, they are required to have and use a CPAP machine while they sleep. The CPAP units that are approved by Prime are those that have a computer chip in them that records usage and can be downloaded into the company database. If the driver refuses to use the CPAP after having been found to be apnic, they are then asked to clean out their truck.
Again, I am not privy to your individual situation nor which company you worked for. However, with my own personal experience with Prime and several other companies is you do not get fired simply for being obese. I can't help but believe there's more to it than that. -
you will never hear a company say that they fired you for any medical condition that would be illegal but when they want to get rid of you they will trump up some other excuse to fire you
Big Don Thanks this. -
You have anything to support this claim?
-
I agree. "Equal oppurtunity employer" just means you dont admit to discrimination.

Where do i even begin? It's more than just walmart though. In Benton Township, we have a Flying J, Wal-Mart, Meijer, Target, Best Buy, Staples, Office Depot, Dollar Tree, and we have numerous dollar generals in surrounding towns.
I like the Flying J, gives me somewhere non-horrible to park my truck. Other than that, those companies are all mega corporations that have destroyed any possibility of getting a living wage in the area. They all need to get out of town. Get rid of one or two, you just put a smile on the face of the others.
Thanks. I just bought business cards and a magnetic sign for my car from vistaprint, which helps my local economy out alot, doesn't it? Not really my fault though. I don't make a livable wage.
Cool. When's the last time you've been here? The economy has sucked my whole life, but in 08 it somehow got even worse. Went from, you couldn't find a job that paid a good wage, to you couldnt find ANY job..... I guess that's what happens when a state's economy is totally based on manufacturing one thing and the companies that make that one thing start failing... -
I have observed this happen to several drivers. I mean FIRST HAND knowledge.

I am not sure where you are standing.Big Don said: ↑I have observed this happen to several drivers. I mean FIRST HAND knowledge.Click to expand...
But, you can be fired for a medical condition. -
Roadmedic said: ↑You have anything to support this claim?Click to expand...OK, in looking back here, I believe I misunderstood your meaning when you asked about backing that up. If you are asking about back up on it being illegal to fire someone over a medical condition, then I did misunderstand you.Roadmedic said: ↑I am not sure where you are standing.

What I was saying, was that I have seen folks terminated for another reason, when the real reason was due to medical or physical condition. Perhaps I am wrong about this, but I thought that the Americans with Disability Act wouldn't allow that.
