    Well, the car is in the middle of the lane, the driver is looking ahead, and the driver does not appear to be talking to a hand-held cell-phone. I think it's a stretch to look at the cup and from that judge the driver to be oblivious to his surroundings.

    Also, according to the text affixed to the photo, speed was gauged at 69/70 mph, so even the bad excuses for tailgating don't apply.
