No he can't. He works for the carrier, not the shipper. His services are for and to the carrier, the shipper is their customer. The FMCSA allows the leasee to see or have a copy of the bills to the customer within a narrow scope but that's it.
His greivance is with the carrier, he has to pursue the carrier for the settlement and he can do this without any problems unless he is leaving out key information.

If he sent the shipper or receiver a bill I'd bet my left nut that they would NOT pay him. However, no one can stop him from sending either a bill.

Hey, OP. It all depends on what you signed in the contract. Contract! That trailer scratch or any damage to the equipment should not determine whether they pay you or not, unless you signed something there that says otherwise, like a fine print where you acknowledged that you'd be liable for any such things. Chances are they got you anyway - hiring a lawyer could be too much for the money they owe you. Maybe small claims court if you have time and patience for that.
