Going into the oil fields. 1099 or w2?

    Im just curious, given the option which would guys choose? Im gonna stay out at least 60-90 days before I go home.

    Depends.
    Are you an employee? Then W2
    Are you a self employed contractor? Then 1099.

    There really is no other (legal) option.

    There is an option. A lot of these companies give you a choice upon hire.

    There is no legal option.
    Let me ask you this. Are you comfortable with the very first thing they ask is to break the law? How long until they want you to break other laws like hos, equipment, and for that matter the pesky law that requires them to pay you?

    If you are an employee, you must be paid as w2, there can be no option.

    I get that, been there experienced it. But I don't think you are following me very closely here.

    They WILL pay me because this isn't some bs dry van mega job. I have a few friends that have done this in the past. Im just curious about how much more youd stand to save if you paid taxes on that kind of money yourself. $2500 - $3000 a week.

    Now I know in the event that I go o/o its no longer an option and at $5000 - $8000 a week i really wouldnt want those taxez taken out immediately. Im single with no kids, so my tax rate sucks.

    Find out what the w2 companies are paying and then figure out if the 1099 companies are paying enough above and beyond that for you to pocket more money after taking on 100% of the tax burden and buying occupational accident insurance on yourself.

    You're not getting it. 1099 is not an employee tax schedule. If you don't own the equipment you're an employee almost 100% of the time. Do you want to take on 100% of the taxes with 0% of the tax write-offs?

    If im w2 i cant write off much of anything. Thats the point im making here. Im already a contractor on the current gig im runnin. Hotels, meals, fuel, maintenance etc. Im just trying to figure out if I need that advantage out there in Midland and Odessa if Im gonna stay out longer than most.

    If you are dead set on going 1099 then it should pay somewhere in the neighborhood of 25% more than their W-2 rate.
