For just over 10 years, the Federal Motor Carrier Safety Administration (FMCSA) had a policy that excluded electronic records, such as Qualcomm records, from use for enforcement purposes. The agency has ended that policy. In a memo sent to state Trucking Association members, it says "if any company uses GPS (global positioning system), FMCSA has the authority to request the records, and use them during the normal course of an investigation. The FMCSA considers GPS records as supporting documents."

Since the GPS records are now considered supporting documents, you need to retain the records for each driver for a period of six months. The polilcy became effective on December 24.
