Hi all,
Great West paid for physical damage done by Receiver. They are back to me about loss of profit that I submitted for the days for the trailer to be in shop. Parts aren't in shop yet.
After a couple of months they are getting back to me trying to pay me only $250 per day, a rental fee when it's going to be in shop. That's unreasonable. Even with rates so low now, that just doesn't make sense. The trailer is estimated to be 8 days in shop.
What do you think?
The Great West representative wrote:
"Since Great West doesn’t have a financial interest in your downtime claim, it would be your responsibility to pursue legal action for that portion. I cannot move forward with settlement until I’ve heard back from you."
To write that kind of response above to their customer? I'm just tight lipped.

How well did you have your financials organized when you submitted everything to them for the downtime claim? The only downtime claim I had with them it didn’t matter how many days I worked during the timeframe they wanted to see. They looked at total days in that period for their calculations.

Yes, I did, very accurate rates! I even added more to the expenses. We actually served customers until the day of the collision for much higher rates than on boards. I sent her copy of the rate contracts. What we have been paid. And all it was from the month of January! And I sent her detailed list of our expenses and monthly dues. They had everything in there!
And I only asked to cover 8 days that's going to be in shop.
We lost revenue from one customer since it happened. So, we are down 30% in general because of this every single month. I know Great West doesn't care about what we lost after.
Is it even legal for them not to get the money we are owned?Last edited: Jul 27, 2023

I don’t know how their formula works. July of 2015 the trailer I was pulling got hit by a Freymiller truck when I was parked at a motel in Woodward OK. I had to submit my financials for April, May, and June. That was a 91 day period even though I didn’t work all 91 days.
I suppose if you’re not happy with $2000 for 8 days of downtime you could always try for a rental trailer for 8 days.

Schedule some maintenance on the tractor and a week of fishing or something.
