I understand and know what/how the castle doctrin is supposed to protect someone, but at the same time there's soo many loop holes that it's more theory then anything else. Pretty much the same for us driving these trucks. A car make an illegal lane change, and it could be caught on video, but if they get a good enough lawyer, they can have the jury believing that because you ate a bowl of luckly charms this morning instead of frosted shreadded wheat, that you were incapable of operating that vehicle properly and shouldn't have been on the road, and if you weren't on the road then the accident wouldn't have happened.
Ya'll are saying that as long as the person is dead, then i wont have to worry about someone taking me to court. Contrary to popular belief, the state can take you to court, heck, a family member that was in another state can take you to court. I all really boils down to if someone cares enough to actually persue the case.
Think about all of the truck drivers who get in accident's (not even their fault) and take out a whole family in a mini van, how does the driver end up with a manslaughter charger if everyone involved in the accident is dead?
Or best case, and most recent example to while killing the perp doesn't automatically give you a "get out of court free card", the elementry shooting in Newtown, the kid that didn't die, the kid that actually made it home that day, is sueing the school board.
Bottom line is, if you shoot and kill, or just shoot someone one, even if they were in your house, your barn, or trying to get into your car at a traffic light, you're gonna need a little more to stand behind other then "The Castle Doctrin", it'll help in some cases, but not all. That's all i'm trying to say.
