    The most important defense to an action for defamation is "truth", which is an absolute defense to an action for defamation.

    but it still comes down the big picture. "defamation of character"

    would you not agree?

    regardless of truth or not.

    if i were the slimeball. and the op was badmouthing me on the internet. and tried to sue me. i wouldn't be sitting there taking the lawsuit at hand. i'd be countersueing.

    Defamation of character is no different than defamation of an individual.
    Your "character" is not any larger or more important.... than YOU.
    Nope, it's not a "bigger picture".

    When me and my wife where team years ago we got stuck by a O/O on some refeer loads .
    After Firguring out the guy was giving us the shaft i just played kool and waited on the next load because he was broke but always give us cash for fuel
    I just took what he owed and left the rest and his truck in a truckstop and told him where it was.

    He didnt do me any favors i wasnt going to do him any.Now i really watch who i work for.
    You shouldnt of returned the truck i would of parked it and when he showed up for it with no cash and the tires where missing i wouldnt know anything about it.

    nope, it's not hard to comprehend. freedom of speech has it's limits. slander on the internet for everyone to see. is outside those limits.

    truth or not. your damaging his already lousy character. in front of the world.

    we'd all like to know who he's talking about. but it's in his best interest to keep that information to himself. if he files suit against the guy. he could find himself in a counter suit.

    I would not give up trucking to be a lawyer if I was you.

    As others pointed out something in writing is not slander and it does matter if it is true or not. Slander is when you say it, not write it and it does need to be untrue.

    It is defamation when you write something untrue.


    Here’s another definition for ya from http://legal-dictionary.thefreedictionary.com/slander

    Could the guy sue him for posting it? Yes, but he could also sue him because he doesn’t like the color of his hair and some court somewhere would need to waste their time dismissing it just like they would dismiss a defamation suit if what he wrote was true.

    On the other hand the OP should sue in small calms court for is lost wages as as long as he could prove he did the work he would probably win.

    I did the same thing to a small company years ago that closed the doors after we left with the load.
    I kept the fuel-expense money that was a few hundred shy of what they owed me.
    Took the truck back to their yard that night all cleaned out and locked up,keys in mailbox.

    2 weeks later I get the Cops at my door arresting me for theft by employee.....What BS!
    I had to pay the dirt bags back! He never ended up paying me a dime after that.

    Any situation like that you need to be careful.......

    I know it really sucks but i would check with the court in that county about filing charges in small claims court and talk with the states Labor Board.

    Post his number here.

    We will call him. Tell him we want to drive for him. Then have him meet us somewhere. When he gets there.....have him call us. I'll ask him how it feels to be screwed by a driver, followed by me cussing him out.

    Won't get your money back but it'll make us all feel better

    The law is clear, snowwy.
    Freedom of speech does not have these limits, IF it is the truth.

    First of all, you're not accepting the true definition of slander, which we provided. The OP is NOT slandering.
    If the OP only states true facts, no matter how bad it makes the scumbag employer look, it is not slander.

    As far as any "counter suit" for stating true facts on a forum, that is groundless, laughable, and has 0 chance of success.
    What part of "Truth is an absolute defense to an action for defamation" do you not comprehend?
    Why are you persistent in "inventing" your own facts about slander and defamation, and totally disregarding proof we showed you via links & definition.

    If you want to show credibility, please cite any links that shows you are correct.
    OR just admit you are wrong on your previous statements, and end it.
