Hauling Hazmat, no CDL or placards

    For starters... Thanks for typing all of this up and doing your research. I appreciate the information.

    I do see companies that haul an occasional load of hazmat that is of reportable quantity... But it is cheaper on them to not hire someone that can legally do it and just pawn it off on the usual delivery driver .

    I am heading back to the same company tomorrow. More likely than not, if I see this issue again, I will take photos and file a complaint with DoT. I won't do so because I am a douchecanoe.. but for the same reason a person would call on a drunk driver. I feel obligated to call in stuff that is deliberately not right.

    I think the quantity exceeds the 'Materials of Trade' exemption which covers the contractor hauling small quantities of HM used in their job. This covers a torch set, of fuel can for job site refueling of small motorized equipment, etc.

    I've seen the DOT, after collecting the fine from catching our driver and the subsequent audit [$6K] went on to ignore the shipper's actions [used an expired placard] and ignored additional evidence that the NEXT export from that customer [which we refused] was transported by a Non-hazmat competitor.

    They might consider this too insignificant to investigate, since the seem to ignore some larger transgressions although the company that screwed us was huge VRS this small building supplier; please consider the fact that your friend could get the repercussions if the DOT does pay them a visit.....

    If he's really really lucky he can get his employer in most of the trouble and him in very little, just play dumb say oh I don't know that I needed placards owe my boss said not to worry oh my boss said I don't need any straps I've never used them in my life.

    He better have some kind of proof that his boss told him that though. Because chances are they might have made him sign some kind of form acknowledging the regulations.

    He needs to have a talk with his boss.

    If you look in the hazmat regulations you have to be carrying a certain amount before placard
