    Not saying this is wrong, but that is based on your average beer, meaning 4 - 4.5% alcohol. If you're a beer snob like me and sniff out a good IPA that is 7 - 8% alcohol be sure to adjust accordingly.

    So if you wander back to your truck after having a few which is parked on private property at a truckstop, and a DOT officer approaches you and you are logged off duty soon to be sleeper, is there any laws being broken ?

    Yes, talk to a lawyer to get the right info but the officer can arrest you because it isn't private property at a truck stop, it has public access and considered open.

    So what law is being broken? The fact that the driver is impaired while logged off duty ?

    if he were to never enter the truck is he still breaking a law?

    I used to have a drink when off duty, then go back to the truck to go to bed. I have also been in a bar when other drivers were knocking back shot after shot at 8pm, telling me they had to start out by 2am. they were only concerned with the .04 part of the regs. Said the cops didn't care about .02 or .03. I know my company did. Policy was get wrote for .02 to .03 the first time was a week off without pay. Second time bye, bye. They say there is a time and place for everything. A little common snese will go a long way on this subject.
