technically yeah, you might be 25 from the cargo it self, but your still in a truck pulling a placarded trailer. the entire trailer IS your cargo.

When taking a test at the DMV, you are testing according to their Handbook, not to any other standard.
They want to see if you comprehend Their rules, not if you know some other rule.
In the handbook, it will say that Cargo Heaters are not allowed with flammable cargoes, therefore, that is the correct answer.
You are trying to be too smart and show off your knowledge of other rules, and all they want is you to show them that you read the handbook.
So read the Handbook, and until the test is over, forget all the other things outside of the handbook.

Oh, and the point of that question in particular is to see if you paid attention to the rule not to use cargo heaters.

YOU need to learn how to read and stop spewing out false info because you lack common sense. There is a difference in TRANSPORTING the stuff rather than standing out there walking around smoking in a parking lot. look it up......oh wait, I did it for you....
49 CFR §397.13: SMOKING
No one is allowed to smoke within 25 feet of a motor vehicle containing explosives, oxidizing or flammable materials, or an empty trailer that has transported placarded flammable liquids in the past.

Good grief. Okay, I'm hauling hazmat. I stop at a rest stop to take a leak and have a smoke. I am transporting hazmat but I am stopped, more than 25 feet from the truck and smoking. Nothing wrong with that. That's where the trick question comes into play. It's a play on words. Kinda like if you're at the fuel desk getting your scale ticket and the broad asks, "what are you transporting?". You're not going to say, "uh, well gee. I'm not transporting anything. My truck is parked". You'd probably respond with "freight all kinds" or something to that effect. So, I stand by my previous statement. You can smoke while transporting hazmat. You just can't do it within 25' of the cargo.
