    no, I think you need to go back and re-read post #24. he clearly says "you CAN SMOKE WHILE HAULING HAZARDOUS MATERIALS AND LONG AS YOU ARE 25' OF THE CARGO"

    Which is incorrect. here i'll post it again. the whole thing this time.

    Guidance for § 397.13: Smoking.
    Question 1: May a driver of a Commercial Motor Vehicle (CMV) transporting HM, listed in §397.13, smoke while at the controls or in the sleeper berth of the vehicle?

    Guidance: No. All persons are prohibited from smoking or carrying lighted smoking materials at any time while on or within 25 feet of such a vehicle. The word "on" includes any time while in the cab, sleeper berth, etc.

    ok, I see what you said. but are you hauling it while your standing in there talking to someone at the fuel desk. no, its setting out in the parking lot. I know what your doing, and you can spin it 100 different ways to confuse someone, but that just ridiculous. now you know its not going to be asked that way on the test. why come on here and try to be a wise ####

    i don't know if you've ever taken the hazmat test but I have. First time and renewals. There are trick questions. Did you miss the first post on this thread? It was marked incorrect because the op chose "smoke in the cab of the truck" when we all would think that would be the logical answer.

    For the same reason the DOT pulls you over for having placards on. BECAUSE THEY CAN. As well as to see if you're paying attention.

    yep. many times. Haul hazmat for a living and have for a while.

    that's exactly right, we were talking about "smoking while in the cab" is how it started out. that's the answer he checked. you remember that? then somehow you left "in cab" out of the rest of the conversation. its obvious to anyone that you can smoke 25 feet away. we were talking while being in the cab.

    I simply followed up that you cant smoke in the cab. that was the whole point. it said IN THE CAB not if your in the truckstop making small talk with the lady at the fuel desk. wasn't trying t start #### on here or argue with you dude, but you deviated from the original topic.

    You can't smoke within 25 feet of a truck hauling Hazmat, and if you are in the cab, you are within 25 feet of the truck.

    And read the handbook, and answer according to what the handbook told you.

    There, all the debate is answered.

    yeah, I agree. also, hauling oversize loads permitted. Ohio DOT pulls me over, asks "what time is sunset?" what is gonna be your answer?

    I never stated you can smoke inside the cab. I also wasn't involved in what "we" were taking about. My first reply to this thread was that it was a trick question. If it wasn't a trick question the correct answer would have been "D. smoke in the cab of the truck" or E. Both A and D.
