Held at Va Scale, someone else ticket?

    They just happen to be the same large carriers that shell out the fat donations to the political campaigns come election time.

    At that point the state has the truck, not the driver. The responsibility shifts right to the state and their officers when they seized the truck, the driver no longer is control. So abandonment is not the case at that point and can't be claimed for something that is their responsibility 100%.

    It is just like when a driver gets into an accident, at fault or not, if the truck is towed to a yard and it sits there, the driver has not abandoned it and the company can't make the claim, and has no responsibility to retrieve it (meaning pay for it).

    As for union trucks not getting targeted, I was going through the scales a while back on 94 east of Jackson in MI and there were a couple Fiat trucks being inspected.

    I've also heard of them doing this for non-payed toll passes. Example: Dirt-bag company is running 60 trucks though tolls via I-pass in Illinois... This can add up to tens thousands per month, and the company decides that it will not pay the bill. Driver gets caught in an inspection, and the truck stays put until the bill is payed. Obviously really crappy for the driver.

    Overweight ticket is a misdemeanor crime? Please tell me you're joking. And California has a bad rep for screwing with truckers.

    ALL citations, traffic or otherwise, are misdemeanor crimes. Speeding, overweight, small amounts of marijuana, etc. are all misdemeanors.

    My last speeding ticket was not a misdemeanor. 10 over, personal vehicle, in VA as well. However, this was over 15 years ago... I'm sure they've changed things since then.

    In a similar situation, I'd likely call a cab and inform the company that their truck and load is in custody of the state, call me when you get it released. Oh and here is the hotel I'll be at, I'll be faxing you that bill as well (unless it's a reasonable distance to home).

    I pay any fines I incur on time, and expect anyone who has any influence on my operation (ie. Carrier I am leased to) to do the same. Failure to do this is likely to train wreck our business relationship. I'm not going to pay for someone else's mistake, whether it's accidental or intentional.

    Traffic is traffic not misdemeanor as far as I know. Unless of course it's a reckless driving, excessive speeding, or DUI situation. So you're saying a seat belt violation is a misdemeanor?


    Yeah maybe if you're going 30+ over the limit.

    if the name is the same on the door, it doesn't matter if its company or an o/o. this isn't anything new , this has happenened for many years.
