HELP! My ticket problem - bad to worse!

    Hello Everyone,

    Hoping someone can give me some advice on this one. A couple weeks ago I got stopped for "Disobeyed Traffic Control Devise". Here's the deal. This is an intersectin where I have to make a hard (almost a "U" turn) to the left off of a busy 2-lane state highway. There is a cut-through used for traffic coming from the county road onto the HWY. For years we have used this cut-through (with caution) It's somewhat blind due to a building on the corner. A few months ago they put up a "do not enter" sign on this portion. This corner is rural (about 5 miles out of a town of 10,000 or so) and is used primarily by farmers. We have never had a problem here - never an accident! Several of us went to the county to discuss this problem (semi can't safely make the corner if we obey the new sign) We were told that we would just have to deal with it and that "Ya gotta do what ya gotta do" OK, so we kept doing what we've been doing for years - cutting through.

    Here it comes! I got stopped - local with big time attitude (big time) He literally yelled at me "Can't you read or what?" I explained the whole deal. It didn't help... he wrote the ticket and kept my license (CDL) as bond. I mentioned I needed the license and I wanted to use my bond card option - NO! He accused me of telling him the laws and asked if I had any other questions. Well, I might accused of being dumb, but I'm not stupid. "No sir" I said, and we parted company.

    The next day on my home from work I stopped off for some fuel for my pickup. The pump doesn't have a card reader. When I offered my credit card.... she "needed to see my ID" I told I got a ticket.... no good. "Gotta have a Gov't issued photo ID. I thought for a minute.... the company I work for buys a ton of fuel here. Put it xxxxxxxxxxx company card. (I was sure my boss would understand and just take it out of my pay) Problem solved! Oh! she said "I thought you looked familiar. you're in here all the time in that cool grey Pete" (my kinda girl I thought) anyway..... no problem I'll take your card. Wheww.... here's where it begins.

    Can't fly, can't use credit card just anywhere (including post office) Then it gets worse. I take off last week with a load and while in Iowa, got pulled into the scale house for "random paperwork check".... no problem, right? Wrong. He informed me that a traffic ticket is not legal as a license outside of the state I got it in, and further more I'm probably breaking the law by leaving the great state of IL. He said the officer who wrote it should not have taken my license as bond. "Note be done with CDL license, anywhere!" He told me "Get it straightened out when you get home, be carefull, and have a good day."

    We plan on fighting the ticket...... but what about all the other? No ID, ticket not accepted, and the whole IA thing?

    Anybody got any answers, advise, help?

    You are lucky the guy at the Iowa scale was decent, otherwise it would be much worse. It's time to either take a vacation or go to someone higher up than the cop, the job goes to their heads, they are pretty bad control freaks when it gets that way. It is their job to be in control, but that is no excuse for breaking the law.


    Normally, if you are in your home state, they just give you a ticket, even the neighboring states often do that, they don't take your license and they don't make you post bond. I think in this case that someone might rip Barney a new 1 but I could be wrong. I'd contact a good attorney, preferably 1 of the trucking specialists somewhere, you need this handled fast.

    Wow, that cop must have had a chip on his shoulder that day or you did something to irk him. I would have requested for his supervisor on the spot and if he refused, dial 911. Dialing 911 is making a recording of whats going on and will help in your defense when it goes to court.

    He was wrong for taking your licenses and is illegal for you to be driving around the country without it. If this was me, I would get home and go get another licenses replacement. Then see a attorney and possibly call the DA in the county where this cop is located and report him. He is not following the law.

    Wow, is right!

    He must have thought you were getting smart with him(the LEO) or something??? Get an attorney ASAP.

    i know some states will hold your vehicle in scales til o/w ticket is paid but this is first ive heard of something like that

    You are lucky that you did not get a ticket for 5k in the scale house for not carrying your cdl. You must be in possession of your cdl at all times while in a commercial vehicle.

    Now that sucks big time. I don't believe he has the legal right to confiscate your CDL "as bond." It sounds like he took it, probably illegally, just to screw you over. Furthermore, I would not be surprised to hear that he will deny having taken it, if questioned. It would by your word against his.

    I agree with the other posters who have said to contact an attorney. (Man you have no idea how I hate to say that!) But you need to get this straightened out. You really did get lucky in Iowa.

    Alabama used to keep your license when they issued a ticket, and give you a receipt that they claimed was good anywhere.

    Not good in Ohio and Ky, people got tickets. I got stopped in Ala for 71 in a 55 (back in the 55 MPH days), trooper wanted to keep my license, I told him why I didn't want to give them to him, he did not believe me.

    Long story short, I guess he got tired of talking with me. He wrote VOID on the ticket and sent me on my way.

    Some places in Tn used to do this to. A city cop gaught me comming off a hill one night on I-40 (55 MPH days again). He kept my license for bond.

    I came home, went to license buearu, got a duplicate license, and never paid the ticket. That ticket was a speed trap sham. I hope they don't come after me, it's only been 30 years.

    Well, I've certainly been wrong before. And of course every state has their own laws. But it sure doesn't seem right to me. . .
    Now this is something you see quite a lot of in some areas. I guess it's the only way some of these areas have to generate money. Then they wonder why folks have no respect for the law, and hate cops. . .
    Oh man, it must be hard to live like that. Always looking over your shoulder. Always wondering if that "harmless" little old lady is really some type of "Super Enforcer" out looking for you. Never knowing from day to day if this will be your last day of freedom.:biggrin_25525:
