Help with a speeding ticket 15 over!

    Thanks for the Congrats! Yes I have learned my lesson! Speeding tickets suck! It's been over 6 years since I had one before this and this was my highest speeder to date. Rogerthat the DA did say that you can negotiate for a different offence. They can change a ticket to anything they want it to be. Like was said earlier its all about the $$. They figure if your driving a big rig you can afford to pay some big $$ to get it off your record. They could have changed my ticket to being something broken or an overweight fine on a truck so it would not show as a mover but would cost up to $1000 for the fine. Since I was driving a personal vehicle that would not work the same to change over, hence the lower speeding, normal fine would be $120 my fine will be at least $200 and probation. Court tomorrow morning. I'll post the exact of what happens after my appearance. Thanks again everyone! Be Safe out there!!

    Speeding 15mph over in a personal vehicle is not considered a serious moving violation. In TX it would show up as a regular speeding ticket with no information as to how much over the speed limit you were driving. Congrats on working it out with the DA. The best option is to keep all tickets off of your record. You should become a member of drivers legal plan. 13.50 a month and 100.00 attorney fees regardless of how serious of a violation or what county the court is in. They have dismissed almost every ticket I hired them for. 1-800-333-drive.

    15 over in NC is grounds to be arrested and the truck impounded.
    I got a ticket for 26 over and paid a lawyer and it was turned into an improper equipment charge.No points and a non moving violation.
    The lawyer was worth every penny!
    Even 10 over in NC will go on your insurance and your rates will double.
    Every state is different but i always hire a lawyer!

    i didnt read all the posts...however, keep in mind, if you do manage to get hired before the ticket shows...companies randomly pull your mvr thru out the year...(some only once a year) and you also have to fill out an annual report stating what tickets you have rec'd in the last year....unless you get it off your record, sooner or later, the cat will be out of the bag....

    Well howdy folks I realized I never wrote an update of what happened Monday! Sorry. :biggrin_2551: Anyways I got to court 30 minutes early talked with the DA in person he dropped the ticket to a 75 in a 65 with a $125 fine. The judge ended up not giving me any court costs so $125 was all I paid. I was in and out of court in 20 minutes. They would not take it off my record but being my only offence in 7 years I don't think it will make a difference. I'll keep that phone number in mind Jack5 I'm hoping I'll never need it though. The company I'm going to work for trucks are governed at 65. I also did learn my lesson with this ticket and have cut off my lead foot and replaced it with a much lighter one. :biggrin_25523: There yah go everyone!     Last December I got a speeding ticket for 15 over while I was bob tailing. I called the city prosecutor and for an extra 50 bucks...like 130 in all....I got a diversion. Never went to court. Mailed in the fine and the 50 dollar "donation" to the city park fund and after six months the ticket was dismissed and never appeared on my record.

    CDL holders aren't suppose to be allowed to do diversions but city or counties don't care. They just take the extra money and smile.

    May want to check the texas Code.
    SUBCHAPTER H. DISQUALIFICATION FROM DRIVING COMMERCIAL MOTOR VEHICLE

    Sec. 522.081. DISQUALIFICATION. (a) This subsection applies to a violation committed while operating any motor vehicle, including a commercial motor vehicle. A person who holds a commercial driver's license is disqualified from driving a commercial motor vehicle for:
    (1) 60 days if convicted of:
    (A) two serious traffic violations that occur within a three-year period; or
    (B) one violation of a law that regulates the operation of a motor vehicle at a railroad grade crossing; or
    (2) 120 days if convicted of:
    (A) three serious traffic violations arising from separate incidents occurring within a three-year period; or
    (B) two violations of a law that regulates the operation of a motor vehicle at a railroad grade crossing that occur within a three-year period.

    Virtually all states have this now.

    Call the court and ask for TRAFFIC SCHOOL, if you need an attorney. You could of course be stupid and represent yourself which rarely works out.

    You should read the whole thread before you post . CDL holders cannot get traffic school . He already went to court without an attorney and made out pretty well .
