    Tell the judge that it was invalid and you were given it back by the DMV clerk and forgot to destroy it.

    INTERNET: You cannot have more than one license. If you break this rule, a court may fine you up to $5,000 or put you in jail

    I'd just explain it to the judge. You probably have to enter a plea first. If you plead innocent your going to lose due to physical evidence. I mean you do have the other license.

    Guilty with an explanation or no contest probably. Just tell him the deal. Get council if you think its necessary and don't mind dropping the money.

    God I hope you weren't driving a Slopar.

    That cop is an imbecile. All he had to do was run your license. When I moved from Georgia to Virginia I was still an active driver. I went to the DMV and had my CDL changed. They gave me my Ga CDL back with a void stamped in it. I don't have a license now just a state issued ID. Those old CDLs are in my safe deposit box.

    It's impossible to have 2 valid cdl's.
    Your VA cdl is not valid. The cop screwed up.

    Yeah I'm worried to death over here about what's gonna happen now. How is it illegal when I just got a new license by transferring it. Also if it's illegal to have the old one, why did the DMV give it back to me.

    I don't think you will need an attorney. I would try to get a statement from the Va DMV stating your VA CDLs last valid date. Show this to the person prosecuting the case and they should dismiss the charge. If they don't the Judge should. GET THAT VA DMV PAPER ASAP!

    This is an easy one people. The OP stated the DMV person said " for ID purposes" which is different than "for driving purposes", right ? Any cop verifies license status when doing a bust. I recently changed from Ky.-Ca. and the Ca. DMV handed back my Ky. license WITHOUT punching a hole in it ! However it's not valid to drive. Any cop can find this out VIA internet thru dispatch.
