Which is why I will never answer a phone call from work when I'm home. Even if they don't do something evil like that, nothing good will come of it.
If they actually leave a voicemail I'll call back when I'm walking out the door.
Before I made that personal rule, dispatch would pressure me to either come back in to work or start my day several hours earlier to cover a load.

I wonder what would happen if you got called for a random, but you actually are drinking at the time of the call.

Why the hell did you tell him you were having a beer anyway? #### it's your time off they don't own you..they own you enough when your on the road babysitting their freight.

The average size person, alcohol dissipates .015 per hour in your system. Any CDL driver reading more than .02% is considered DUI. This is pretty much anything more than 1 drink. If your involved in an accident your fried anyway.. Best bet, give it at least 12 hours before driving after your last drink, better yet, save it for hometime.

You sue the company for violating the law would be my guess.
    (m) A driver shall only be tested for alcohol while the driver is performing safety-sensitive functions, just before the driver is to perform safety-sensitive functions, or just after the driver has ceased performing such functions.

Yep ! At Morehouse I tell them when ill be ready and never hear from them but in the early 90s at Hill brothers I'd barely get home and they would be on the phone .
Back then SOP in the house was no here's not here and don't know where he is or just don't answer the phone !

I didn't answer the phone once and was almost marked down no call no show. I answer the phone but if I was drinking I wouldn't say anything. Id just say i cant make it in until the next day. Specifics aren't their business.

Whats interesting is I am their night driver and they always call during the day when I am asleep. Then they give me training saying if I answer the phone while I am logged sb I am "functionally asleep" and responsible for car accidents even if it isnt my fault because I violated sb log by using my friggin phone to answer dispatch calls.

Fmcsa doesnt recognize work related phone calls during off duty/sleeper birth as on duty work. So no violations by you driver, unless its a company policy.

It amazed me that Schneider, in their online CBT, emphasized that I must log on duty while doing them. WTF? I just did them in the comfort of my home and didn't log them. Next thing, studying for a DOT exam will have to be logged On Duty. Logs are such BS. Bathroom trips should be logged as well. Sometimes that can be hard work depending on the state of your digestive system.
