I got in trouble in Pennsylvania for the same thing. I stayed for a day in Harbor Creek and just logged it all day in the sleeper. He also cited me for not filling out my DVIR that day as according to him, you have to fill out one every day you are on the truck, even when you don't travel.
HOS question-Is there a Maximum time allowed in sleeper?

Look everyone here is the problem.. The troopers job at an inspection site is about numbers they can say all day long they don't have quotas and this is true they call them goals now.. They have to find things wrong.. When you go into a dot check with 24 hours in the sleeper or better yet 72 hours.. He knows you are in the wrong and if you lie about something so obviously false what else are you hiding then they dig deeper.. If they find out you are a naive rookie they and you didn't know anybetter they will right you a ticket for lying on your loggs put you out of service (normally) for 10 hours..
I haven't had a violation in over 7 years and have went through a lot of road side inspections.. I am always freindly and courteous to them, but the last violation I did get during a dot inspection was in AZ in 04 for not wearing a seatbelt during the brake portion of the inspection.. brakes were released and I was in control of the truck.. couldn't hear the officers instructions (under the truck) so I opened the door and put my foot on the battery box.. 185 bucks later I learned a lesson. He was crooked and couldn't find anything else wrong that day.. -
so you guys are saying, when I am on my 10 hr break, I need to log off duty when I leave the truck to take a leak or shower and then back to sleeper after ?
never have. straight line,in the sleeper section, from time stopped to time of Pre-trip in AM. not been a problem.
when I'm home for weekend that is off duty. -
No.. That is suppose to be the idea.. Besides it is the troopers job to profile if you will things like this. Logging line 2 for more than 10 hours is asking for trouble.. I know it shouldn't be but this is the real world and we are easy money.
-
The point is that is not what we are saying it is what the law states.. Do I do it no.. but if you log 72 hours straight in the sleeper the officer knows you weren't in there for 72 hours straight..

**shakes head** So this driver sat for 3 days, then was cited and fined another 2 days pay for not logging his trip to the can? Sounds like he lived in a truckstop for a week for free.
This thread should go to the "new drivers" thread.
SO you wanna live the glamorous life, travel the world, drive the big rigs???CAXPT Thanks this. -
what if he can take a leak in less than 7.5 minutes
CAXPT Thanks this. -
Good grief. The driver should be cited for basic stupidity if nothing else. There's no need to log that kind of time "sleeper". How much more effort would it have taken to move down to Off Duty for a day as opposed to Sleeper? Off Duty takes care of a lot of potential issues, and it doesn't make a dam bit of difference what the driver may or may not do in that time, or where he may or may not have slept in that time.
LaBubba, CAXPT, scottied67 and 1 other person Thank this. -
Exactly. So why would a cop want to cite someone for what most people would call a "technicality"? If that puke was a normal human with feelings and emotions instead of a robot like most of them are, he could have said "next time just make that off duty"...
Did it really effect the safety of the motoring public? Did it benefit the driver in any way? Did he need to "cheat" to gain anything? NO!
These pukes go to classes for weeks at a time two or three times a year to learn the little intricacies of FMCSA log laws. Sometimes we have to actually go out and work to pay our bills so how can drivers know as much as guys who get paid to sit in class after class learning these things? -
regarding Post #19 ... agreed, they will nit pick. You know this, I know this, we all know this. It's no secret. So WHY IN HELL give them more stuff to nit pick when it costs nothing to eliminate this target?
CAXPT Thanks this.
