HOS Question?

    I typically cross a scale 5 times over the course of my days, and all of MD's finest are well aware of the local exemption.

    I was reading up on it, and even through we stay within the radius I don't think my company is eligible due to the shifts we work. Most of us run from 12-15 hr shifts, and rarely take a full 10 off.

    The drivers are correct. If they stay within a certain radius of their home terminal, which some states have set at 150 miles, they are not required to use logs.
    Some states like California require you to keep your #### sheets proving your deliveries and that you didn't go out of that radius.
    This type of local driving also allows the driver to drive on a time clock instead of log books, there by driving longer.

    but if you go out of the area for 1 day out of the month you have to ave the logs for the whole month. I am in that delimma and i log it all. Never know when a scale will ask for an inspection and a log book. Really hard to prove you are a local driver with your word. You get the ticket and get your day in court to get out of it. Better yo log it all.

    Never heard of that. Not saying it isn't true, just haven't heard that. How come most drivers only have to have last 7 days but you got nailed for not having an entire month? Makes no sense to me.

    The local driver who went out of hourly/local radius would reset to the hourly/local logs once he/she completes a 34 restart. Been there with the bay area CHP boys and girls...today and the previous 7 are all that is required BY LAW.
    Used to run fuel over to Mammoth Mtn ski area from Sacramento. During the summer we could stay in CA, but in the winter, 88/89 closes and we had to go through Carson City. So crossing into NV, even for the 82 miles, we went from local to OTR for the week. Restart and back to local.

    We just had drivers get inspected going into Ga from NC. They played dumb and tried the, "dont need a log book because we are a farming company" bit and were promptly reprimanded and were required to show their log book for the month. This was requested to see how many times they had violated the 150 mile rule. They didnt have log books at all..... so obviously they got tickets. We were told by Ga DMV that expect to be able to use the logs from the last month to determine a routine yet were only interested in the last 8 days to write infractions. They were very adamant yet very helpful. We aren't a trucking company in the normal sense. We use big trucks to move equipment around everyday. We usually dont go outside the 150 mile radius but the NC and Ga DMV say they can request the logs for the last month. And we are on papper and drive pre 2000 trucks that are exempt from eld laws. I always have run a log book so I didnt get a violation, but this incident has made me the new log book class teacher for our company. All our trucks are mechanical and have no computers. So the only record the dmv can get on us is log books.

    DMV says we have to show logs for all days if we go out of the radius for one day.

    Please read carefully.

    They can REQUEST anything they like.
    You are only REQUIRED (BY LAW) to carry the current and previous 7 days.

    As I understand it, since I am local and very seldom log anything (time cards are great).
    You (the driver) are only required to log if you drive outside the air mile radius or OVER 12 hrs. I BELIEVE this is a Federal regulation not state.
    Again that is how I understand it. Inside air mile radius and under 12 hrs, no logging required.

    We always go over 12. We usually drive a couple hours to the job, do the work and then go home. The Company has never run them before but are getting a lot of violations lately and I personally fear an audit is coming. We can only have so many of the exact same violations in the exact same scale house so many times. I thank you for you clarification. Sorta seems like Ga is building its case. All the violations are happening in the same places. We are one of those companies that most drivers dont want to work for. Hot rod Macks, so freeking loud your teeth chatter. Cant get out of their own way until they wind up to 2200 rpm. When was the last time you had to adjust your slack adjusters lol? We are farmers that drive trucks ,lol, and the DMV is catching on that we do more than local. There is nothing electric for them to check. Im sure its frustrating for them when we pass inspections. Most of the guys look at it as a game with the DMV. They dont get it it that we are held to higher standard. I get paid pretty good money to drive a lil everyday and do manual labor. If the truck were nicer it would be great.....sometimes.
