HOS violation

    Its happened to me a few times . I'll get in to get unloaded and they take forever ..
    in TX once I was at a Walmart DC for 6 and a half hrs and then they made me leave .
    I think I was over something like 45 minutes on my 14...

    Shippers and receivers could give two ##### about your log book..

    If it ever happens and the customer is giving you ####, just give the DOT a call and explain what is going on and they will resolve it by either A: letting you stay or B: provide you an escort to the nearest place to park without the violation. Just be sure to notify safety and make sure they are OK with it and make the notation on that log or get it in writing by the officer. Usually its not an issue for them to do so.

    Seriuosly, people should know that in terms of FMCSA regs, "safe Haven" is a hazmat thing, and does not pertain to HOS. I don't know what rule or regulation the link is referring to, but it is not an FMCSA thing.

    The link is not referencing any rule or regulation. People should know that according to FMCSA, a "Safe Haven" is a place to park certain HM loads so the driver can step away. They don't use it in any way to allow an extension of 60/70, 11 or 14. I know the term gets thrown around for this purpose, just saying people should know.     Thanks drivers for the many different viewpoints and advice on this. TO CLARIFY:
    My safety mgr. DID NOT alter my log entry. My company is pretty ethical in that way. He just added a comment about the violation. Also my above statement about paper vs. Elogs was simply saying that any driver on paper would have not have entered "driving" while moving the truck 3 mi. to a safe place, but I also said it would still be an illegal move nontheless just no record of it. If an accident occured during the move or the driver is pulled over, then the law is still being broken EITHER WAY. Paper wouldn't come back to bite you later I guess is the big difference.

    I am also EX Safety. You are allowed to drive to a safe place with in a reasonable distance. (5) miles. Don

    No such law or allowance. Friend got caught driving after kicked out of the walmart dc and no parking in the local fuel stop. Was caught driving over the 14 trying to get to a Walmart a few miles away.

    They issued a 14 hour ticket, and put him out of service for 10 hours. Went to court to try and explain and the judge said a professional should adhere to the laws and did not change or reduce it.

    Sorry for the double post, I thought the first one disappeared. This has been covered here before. Roadmedic thank you, I just hate to see this mythical provision thrown around. It's just not there.
