The shear distances of over the road trucking make a 40 hour week impossible. Paid by the hour for OTR would only work without overtime.

It would have to be based on the 70 hour clock, no pay for off duty time. When one is off duty they are clocked out.

The 40 hr OT rule is Federal Law, under the FLSA since 1938.

70 hrs. Pays 85 hrs. Currently the Federal minimum wage is about $7.25. So a 70 hr. work week would pay a whopping $616.25 per week. On the other hand, being paid for all the time spent in command of and being responsible for the Truck. 7 days a week would pay 232 hrs. for a paycheck of $1682.00. Maybe minus a 34 hr. break. Only paid 198 hrs. for a paycheck of $1435.50. Some States have higher minimum wages, a few don’t have any at all, a couple have them set at lower than the Federal rate. Regardless the Federal rate of $7.25 applies, or higher depending on the States minimum wage Law. $1435 seems fair for an OTR Drivers minimum pay for working 134 hrs. at a time, and taking a 34 hr. reset.
