You are under the 70 hr in 8 day rule if: "...70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week."

You are under the 60 hr in 7 day rule if it does not.

It makes no difference if you are long haul or regional.

    No donuts necessary.:biggrin_25514:

wasn't concerned about the long haul or regional.

it was the OTR vs. local trucks that go home every night. :biggrin_25514:

Thank you that finally answered my question. As a yard dog he is still considered driving. So after the 60/70 he could do other work just not get behind the wheel of that truck. Thats good to know, So basicly even in this Job his ability to work overtime is extremely limited. These regulations suck...I understand that driving is a dangerous job, however i'm a nurse working 12-16 hours a day 6-7 days a week, and Drs and surgeons work 24 hours at a time, and we have the lives of people in our hands all the time and no one tells me I can or cant work a certain number of hours, We need more funds I work more, we need less I can work less. I know one thing in the trucking industry you can not make a decent paycheck anymore. And most of the time drivers are not driving they are sitting waiting to drive not getting paid. That is the only job where you show up for work and dont get paid if there is not a run...Hey I can really see this catching on...retail stores, cashiers, fast food, Show up for work for 4 hours, But no business, go home no pay..Yeah the labor board would be all over that. Either way im really glad my Hubby is off the road and home now. Good Luck out there to the rest of you drivers and stay safe. Thanks for the info

395.8 is the regulation on how to fill out and maintain the RODS (record of duty status), including paragraph (k)(retention) and paragraph (f)(1)(entries to be current).

100 air mile drivers are exempt from THESE requirements.

They are NOT exempt from 395.3 Maximum Driving Time. (11, 14, 60/70 hour rules)

it's a debate that's been going on scalemaster. it's a assumption that everyone works the 70/8 rule. local or long haul. no one works the 60./7. if that were the case then why have the 60/7 rule.

you came along with the actual answer as to what operations run what hours. so now's there's an understanding.

Hi snowy since time cards are logs is there a way to prove or show 'on duty/not driving' in the course of your day? I'm in the same situation as above. I work an 8 hour shift. There is 'on duty/not driving' during my 8 hours. Or is the time card the log and it's determined that since I work 8 hours it's considered driving?

I have a question about hours of service in the US. I will be starting a run that requires me to drive from Surrey BC to Seattle WA then Portland OR and then back to Surrey BC. I've been doing trips 160km within my home radius. Now there moving me toward a longer run. Can someone just break down for me how the HOS works in the US.

according to the scale master. your techincally driving. (if i remember the discussion some months back).
it depends on the operation though.

when i was local. hauling dirt. all we did was a time card. unless we were over 12 hours. then we had to do a log graph for that day.
we also ran under the 60/7 rule. becuase the trucks only run 6 days a week.
