Most animals eyes glow because of a layer called the tapetum lucidum. As it reflects light they literally, are blinded by headlights.
While it is typically considered a not-at-fault accident but you have to be careful about how your report the incident. If you are "Overdriving Your Headlights" you can get a ticket for driving "too fast for conditions".
While most people drive the speed limit at night despite the limited visibility there is a difference how officers, insurance and companies can deal with an incident where deer ran onto the road and you hit one vs hitting deer that were already on the road once they are visible.
As you only have ~180 feet of visibility with low beams and ~350 feet with high beams you couldn't stop even at 55mph in a semi. The perception distance at 55mph is ~142 feet. Obviously no one drives sub 40mph at night but in theory if we were all abiding by the rules we would be.
If you deal with an officer or insurance adjuster that is having a bad day they unfortunately can justify placing the driver at fault with deer that were standing on the road. As deer often do run onto the road in front of traffic it is probably best to think about what words one uses when describing and documenting the event.

I have come close to smacking deer while in the process of taking off and landing an Airplane. Common sense tells you these things are not preventable. What a carrier decides is a different matter. Just turn it in and write it up as it happened. Not much you can do now.

And that's not even that much damage. It looks about like half the other Cascadias on the road. -
I just decided not to even try to slow it down because of the vehicle to my left right at about my bumper line. Even if I could safely swerve to miss the deer, that car was still there. Also I knew the car saw all those deer and he might have tried to move behind me, for all I know. so I didnt attempt a brake at all.
Those were my thoughts anyway. All I can do now is tell safety all of that on Monday when I call to follow up, like Moose said. -
One day X1Heavy was landing a Boeing 747 at LAX. Touched down at 250 MPH and a herd of elk ran in front of him. He didn't have enough speed for lift to get over the herd, so he did the only other thing to do.
He lowered the flaps and got as close to the ground as possible, and right when he got to them he blew the air horn. The elk were so surprised the jumped into the air and the plane shot right under them. He saved 752 passengers that day.
