Seems like a good thread to put these questions. I saw that LogsRus hasn't been seen in 3 weeks and this is a pretty active thread without having to start another one.

1.) If you will NOT use all 14 hours and go off duty/sleeper berth for 10 hours before the 14 hours are up......does that reset your 14 hours once you come back on duty/driving? For instance: My original 14 hours is up at 12:00am tonight but I am done for the day at 10:00pm tonight. I go off duty/sleeper berth at 11:00. Will my hours restart at 9:00am tomorrow or 10:00am?

2.) When logging your 10 hours, can you log off duty for the whole 10 hours or do you have to log the 8 hours in sleeper berth as being in the sleeper berth?


I'm sorry ya'll. My little brain in now in overheat mode and I think I'm starting to even see some smoke coming out of my ears. I have spent hours since last night looking over threads on log and driving rules and also went over to the DOT website and seem to be comprehending some mixed answers to my questions....but then again, I'm overloading myself too so everything can't sink into my brain.

That is my 02 cents worth

 

1. Anytime that you are off duty for 10 hours you will reset the schedule for the new day of 11 driving and 14 window. Exception is if you are exceeding 70 hours of duty.

2. As Mgassel said. Log is as you do it. If you stop for the night and eat, you could have 1 hour off duty. Then if you sleep for 8 hours it would show sleeper. Got up ate or showered, it would be off duty.

Both are basically resetting the day and therefore not looked at by the DOT as much as they do the activity on lines 3 & 4.

The above works fine as long as you are not running close to the end of the 70.

 

Do you have to log 8 hours consecutively in the sleeper? or can you do 6 hours in the sleeper .25 hours off duty then 1.75 in your sleeper? The reason I ask.....What if mother nature hits in the middle of your "sleeper" time and you gotta go into the truckstop to use the potty? ......you can't very well poop in a cup in your truck!

 

I would not worry about changing duty for mother nature in the middle of the night I never did and still will not when I start driving again.

I belive that you must have 8 consecutive hours in the sleeper then what ever with the other two.

 

Ok everything was ok until I got about 3 replies down and saw someone say that it's up to the company! I could not read any further as I want to make sure I have time before bed to respond to this! So please do take this as the final answer!

NO the 11,14,60 or 70 hour is NOT up to the company! This is a federal DOT regulation.

Lines 3 & 4 go towards your 60/70 hour.

If you are following the 60 hour rule your total lines 3 & 4 can not total more than 60 hours in 7 days (7th day being the day you are starting to working/today)

If you are following the 70 hour rule your total lines 3 & 4 can not total more
than 70 hours in 8 days. (8th day being the day you are starting to work/today)

I have the 70 hour explained (I think) and it's in the threads. WEll I know the part on how to fill out the recap is in there and that's just a percentage of how they look on the log book .

You can be on line 4 passed your 70th hour but the hours you are over will come off the hours you have available for tommorrow.

 

I would not really give that advice! If he was to say yes sir I got out and went to the bathroom etc and he is logging in the sleeper then he can get written up for a false log and fined.

What I would of responded to is his original question:

No you do not have to sleep 8 hours if you are on your 10 hour break (that's only if you are split breaking do you have to spend 8 hrs in the sleeper).

You get a 10 hour break 3 ways

1) 10 hours off duty : Meaning you was away from the truck doing your own thing for 10 hours (hoping some of that is rest time)
2) Sleep 10 hours : Your body must be in the sleeper the whole time to log 10 hours sleeper (of course yeah you can fib about it, but make sure you understand if you was out of the sleeper and the officer can prove it he can write you up for a false log, so don't say yeah I was inside eating. Then again can he prove it other wise?).

3) A combination of lines 1 & 2: There is no specific amount of time to be logged on either one as long as it's a 10 hour consecutive break.
off 1 hour, sleep 4, off 2 hours, sleep 2, off 1 hour. That is all ok!

There is a BIG difference between lines 1,2,3 & 4 and you as a driver should understand all those lines completely so you know what to log when you need to know

Thanks Logs....I got confused between reading here and over at the DOT website. For some reason all I kept seeing was 8 consecutive hours of sleep for the break over there and thought at one time I had read over here that 10 hour breaks were allowed however as long as you stayed off for 10 and stayed in line 1 or 2.

Hubby takes his 10 hour breaks as they work best for him. I had worried because he ran in to potty and changed his status up to line 1.

I actually have made a make shift log for me to keep at home now. I have everything documented.....every stop complete with address, trailer numbers...any and all info he may need at a later time just in case he forgot to document it. I even have his weight and trailer heights (measured by him with a tape measure) on some. LOL
