My wife owns trucking company. Semi tractor and the trailer are registered under company's name and I'm the driver. Long story short, I have to establish new trucking company and I want to lease the truck and the trailer from my wife's company. I'm not sure how to handle ICC authority (I assume that I need my own ICC) but have no clue if adding my new company to exsisting carriers policy will do the trick. Can someone advice, I'd greatly appreciate

What you will have to do is file for a new dot# and icc#. Simple process costs about $300 plus the process agent. Then you have about 30 days to take care of getting insurance, drug testing implemented and all the other gold stuff that goes along with your authority. I have never personally dealt with this but a lot of times I see a comp may name, then leased to so and so on the door. Seems like that would work. Otherwise you'll need a new registration. Insurance is going to be high for a new entrant and new MC and that 30 day wait sucks. During those 30 days you can't leave the state under that MC. You can haul in state however. While waiting for your authority to be approved. Its a PITA and is a beauty of being an exempt carrier. If you haul ONLY exempt goods you don't need an MC all you need is your DOT#.

I have my authority, insurance, dot, etc through the company. I have the truck in my name and leased it to the company. They can complete this at IRP. I think it's called a 330 form.
