How long does it normally take before a traffic case goes to trial?Sounds like TX picks on cdl holders more then any other motorists OP may be wasting time and money but who knows.I wish him the best of luck if he does fight it.

I live in San Antonio and about half the people here don't know how to use turn signals.if you think sa is bad, you should see houston, no one there uses them. the only unmarked (not really unmarked because the police decals are painted to match the vehicle) police cars that i have seen are the crown vics. you can fight it but would cost less to pay the fine than to pay lawyer fees. i dont think you can lose your cdl for one ticket.

You can call the clerk of courts there. He/she is almost as powerful as the judge. It's the judges right hand person to try and take care of as much as possible and resolve before coming into the court room. Call and ask if you can pay the fine and nothing on your record.

When I was working I had traffic courts 2 times each month. Now the copy I dive to court is right when I get ready to have my trials etc.

Oh left out for the officer to write that ticket there may have been more collisions in that area or more collisions in that jurisdiction caused by that infraction.

That's who convinced the judge to dismiss my no insurance ticket. I was still living with my dad and borrowed his car while mine was in the shop getting some work done. I got stopped in El Paso (was living in New Mexico) and my dad's insurance card was expired. When I went to court, I produced a copy of my dad's insurance (we both have USAA) that showed his car was in fact insured at the time. Judge frowned and demanded to see an insurance card with MY name on it. I said but I wasn't driving my car at the time. Didn't matter, he wanted to see my name on one (come to find out that Texas doesn't legally recognize you have "insurance" unless your name is on the policy to get an expired insurance ticket dismissed). I produced my insurance card. My policy renews in May and November and I got stopped in October. Judge tosses it back.
"This card is valid as of November, I need to see one from October."
"My policy renewed in November, I don't keep the old cards and policy in my car."
Clerk interrupted. "I'm satisfied he was insured at the time your honor."
Judge dismissed the citation.Skate-Board Thanks this. -
I have learned on this Forum that "points" received on your license are based on what type of vehicle you are driving. In other words, getting a ticket in your car is less points than getting ticket in a CMV, for the same infraction.
But yeah, I would fight it anyway. -
I'd wait until the ticket gets entered into the system, which usually takes a week or two, and check it online to see what the details are. If it has points I would find a good traffic attorney and let him deal with it. Around here it costs about $150 for the attorney to plead not guilty and show up to court for you. Of course if you want to you can plead not guilty online and show up to court yourself but you'll have to miss a day of work most likely.
Fight it either way. Who knows the officer might not show up or it might get thrown out for some other reason. Happens all the time. Might as well have your day in court and see what happens.
