Internal policy violation

    Hi I was student /driver for a company that the name starts with C
    I took my test and pass I wait for a instructor for 4 days and after that was ask if I mains taking the bus to Colton it was 10 of us at the Colton bus station I find out we where replacing a grup of students that got in an accident with one fatality ,after 2 days was assign a cool instructor for my face 1 200 hr in all this time I haven’t take home time jet and tell you you will Around the end of face one ,we end up continuing face one for another 100 hrs extra on my way to the east coast I call my student manager and left couple messages no ansew so I send a request tru Qualcomm and I got a agnolage back I also got a message warning me of a hold do not dispatch for reson of my permit expiration 28/05 directing me to contact my student manager that I can’t get on the phone with more than a month with out a home time or day off I ask my instructor and becuse he was going on home time he suggested to drop me in a hotel that this company use for students and he tell me that he will feel my up grade paper on the long hollyday that way I can’t up grade and enjoy some deserved time of /home time becuse no body made arrangements to send me to North Carolina to get my hard copy and have some home time first in 3 months
    So I was of the truck finish my practical part of face one
    He took me to Walmart to buy food for my next trip face 2 with a new instructor and I purchase a bottle of Bourbon then he drop me whend after second day they ask me why I haven’t show up for upgrade I informed them that my instructor was supposed to give me my papers back but he has not jet so they did not like me staying on the hotel and next day I receive a call asking me is I had a bottle in the room when I explain that this was my time off they fire me , the cleaning lady wend tru my things and find a bottle took a picture give it to hotel management and report me to c company
    Now is on my report and I can’t get a job driving or any other job I apply for 100 positions and no one hire all becuse they reported I violated company internal company policy
    I am on dispute
    Any advice or feedback

    Learn the laws governering you job and put the alcohol away.

    As for can't get a job for that "policy violation" I find very hard to belive. What else is on your record you neglected to mention?

    How do I say this,,,,, sometimes we make boneheaded decisions. If the bottle was in the hotel room you might get away, maybe, you can fight it. But if company policy was no alcohol, like most companies, and you went to Walmart in company truck you will have a hard time fighting that one, in my opinion. I wont loose hope. Someone with more experience than me will surely help you out. Best of luck.

    I had a hard time deciphering the original post. But it sounds like the OP was in the hotel on the company’s dime while essentially waiting for them to get his paperwork sorted out...?

    You need to understand that even though you were at the hotel, you were still representing your company, still subject to company policy, etc. in other words, you were still “at work.” It’s a little different than having a few beers in your garage on your hometime.

    We have/had another member on this forum who got fired a while back for getting drunk while staying in a company-paid hotel, waiting for his truck to get fixed. It caused quite a stir on the forum. I don’t know what ever happened to that hero, but I would be very surprised if any decent company will hire him any time soon.

    Best thing to do is just keep the booze at home.

    If they reported an Alcohol Policy violation on his record, it will probably be very hard to find a job driving? At least for some time anyway?

    Companies will tell you no alcohol in the hotels the rent out. First thing I was told every time I checked into a hotel as a student, make sure there is no alcohol cause you will be fired.

    Did the company decide not to load you because you do not have a Commercial Driver Permit that is Valid? What is this 28/05? It does not correspond to any particular month and date.

    Again what is face 1 and face two? I don't understand. If I go phoentic and switch to the word Phase, then it makes a little more sense. Is that what you are trying to say?

    If you had alcohol in the hotel that is under your company for whatevewr reason out you go. It's the same as having alcohol in the truck. The only alcohol you need to touch is to be drinking at the bar downstars and hand the empty glass to the bartender when you are finished. Make sure you are sober before touching a big truck using 1 glass or can equalivant per 8 hours to metabolize it.

    I am sorry you are struggling. But being under the wing of your company in their hotel in their survillence (The maid...) that's pretty bad of you to do something stupid like bring in alcohol. Now you are gone. And that's that for a while for you as far as hireablity is concerned.

    This industry has to be intolerably STRICT against ANY alcohol or drugs. If they so much as SEE IT around YOU anywhere even if it's a cleaning girl... you are gone. If they see it on your record, where else do you think they might find it, in the sleeper berth maybe? You have shown that you are a drinker on company time, property and so on. Splitting hairs on being off duty etc. That's not going to defend you.

    If you wanna drink, I don't care. But WAIT until you get OFF property far away, drink at the bar (AND LEAVE the empty containers there.) or drink at home. DO NOT let the stupid company and their maids catch you with that. DO NOT go near your truck within 8 hours per can of alcohol or one shotglass. If you had two shots you wait 16 hours. You might tell me that it takes 6 to enjoy it. (For you in tolerance maybe... but again if you are caught anywhere near a company office with alcohol in your system you are so gone.)

    Pick your poison carefully and never in sight or survillence possibility of company, their trucks or ANYTHING under their money such as airport, hotel etc.

    People will turn you in. If they don't THEY are GONE. USUALLY they are not in a economic position to get another hotel job or something like that easily. After all if the manager or food service got there saw the bottle after maid left, they might suspect she had a drink.

    These things are a ripple in a pond after you toss the stone... in this case the can of alcohol in the hotel room. The price is unemployment for a while. (Not collectable, you were fired for possession of alcohol.)

    If you really wanna make a federal case don't you will be shredded in court and all that money wasted.

    Looks to me like he meant phase. All of that is irrelevant anyway. All that matters is he was caught drinking in company hotel room.

    Well that's all he admits to anyway.

    Carolina Cargo in Rock Hill, South Carolina might hire you if you have the hard copy CDL.
    Tell them you had a bottle in the room, but had not been in the truck with it because the trainer had the truck, not you. Tell them you were in the hotel room waiting for your trainer to finish his home time.

    Look, they have the burden of proof. If you didn't leave a paper trail of this to the company, dispute it. While you're at it, hire an employment attorney to send them a demand letter threatening a civil lawsuit for libel if they don't immediately remove that from your DAC report. You can hire a lawyer on a contingency fee if you have a case with merit or you can cough up a few hundred dollars, which is half a week's pay as a driver.
