Intrastate permits

    Most states have a franchise tax for doing business in the state. Some states(NJ for one)go after it hard. Most ignore it unless you come to their attention some other way.

    To add to the confusion, try calling some of those states and getting authority for intrastate. No one knows what you are talking about. We are based in TN and looked to get this and they wouldn't take my application.

    Now the taxes is something completely different and as of now it seems that NJ is the only state that hammers out of state corporations that aren't registered in the state.

    Correct, but again, the Amtrak Act excludes interstate transportation workers from multi-state taxation. A single owner operator with no employees with a sole prop business structure does not have to pay those taxes (except in their home state).

    Amtrak Act deals with income tax, not a franchise tax. Different states have different definitions of a foreign corp. Many include LLC(P)'s.

    Based in TN and you don't need it there. Most states cover the intra through inter when based there.

    NJ, PA, NE, NM, TX are just a few that will hammer you. NJ is 550.00 minimum, sales based. NE and NM is mileage based.

    And if you want to confuse it more, no intra is needed if the origin/final destination is out of state. Freight comes from overseas and you PU at customs warehouse you can deliver it in that state. PU at the company that purchased(or their agent) it and you need intra.

    Try calling (800) 299-1700 and selecting option 2. Lady who answered seemed knowledgeable and confirmed my understanding that they require a TXdot even when picking up international loads at a broker in Laredo/El Paso and delivering them inside Texas...

    NJ is without a doubt the worst, but CA, PA, MI, NE, NM, and NY are some others.

    Dont you need intra if you are only gonna operate in state ALL year, but if you have interstate authority it will cover you in ALL states..?? Your registration will have all the states listed on it that your allowed to run in..it doesnt say anything about rules for picking up and del freight in one specific state..Most intrastate companies only operate in their registered state anyway

    You would think so but every state is different. The reason I used Texas in my example was because I was reasonably certain they do require any out of state interstate carrier that hauls an intrastate load in Texas to have a permit for that. And several others also. I just didn't know which ones. My concern is, if I get pulled over in Texas while I'm hauling a load from Fort Worth to Dallas (for the sake of argument here the freight originated in Texas and ended there, no imports, ect) if I don't have this documentation in my permit book, able to provide it at LEO's request, will I get a ticket? I know we are permitted to do intrastate in Texas but I don't have the permit. I need to look at double yellow's link to find answers. I just want to make sure I've got every base covered for potential inspections. I do lots of intra state hauls in other states.

    Easiest way is to go to the state motor carrier association. It's easy to file, no need to have an agency do it for you. Just like your MC#.
