I've been a fuel hauler in NC for 8 years. Spotless record, never had any disciplinary problems. My company recently terminated my employment for something I did not do. It's hearsay from one employee who doesn't like me. When told they were terminating me they did not have me sign anything nor did they ask for my statement. There was no investigation and no proof that I did what this other employee said I did. No one called Saftey or risk management to report the "incident". In fact, I was the first one to let safety know what was going on. I have contacted the higher ups in the company and HR has contacted me, but I want to know if there is any other recourse should they choose to uphold my termination. I would never do what the other employee has stated he saw me do. I'm an experienced professional and it is disconcerting that this is happening.
Is there anyone I can call for wrongful termination?

in utah, if you worked for me. i could fire you just for the heck of it.
don't know about your state. -
NC is also an at will state. I just don't see how they could let me go without investigating the alleged incident. I'm a good, loyal driver.

I bet you are an "at will" employee . They can fire you for no reason.

File a grievance, I'm sure your shop steward.... oh wait never mind.
Rollinsteady and joseph1135 Thank this. -
depends on what you allegedly did. It seems your original post was trying to dance around it, but if you were innocent why wouldn't u tell us what he said?
-
What did the other employee "....claim...." that you did?

My thoughts exactly

I went to a store to deliver fuel. I was using someone else's trailer because mine was down. His third compartment didn't fully drop. On my way back to the loading rack I pulled over because I realized there might be product on the truck. When I got out to check it out I saw our mechanic pull up. He got out and asked if I was okay. I said yes and that I was checking the trailer. I bucket drained the first 2 compartments and there was nothing. When I went to pull the 3rd Handle I realized it was tight and that there must be product on board. I then went to the loading rack to drain the remaining product but when I checked it out I realized it was too much product and went back to the yard to see if I could load around it and return to the same store I had the retain at. Dispatch put another load to the same store on me and I loaded around the retain and took it back to the store. The mechanic told my TM that I pulled the handle and spilled gas all over the side of the road. It seems to me that if that was the case, risk management would be called. Or safety. None of these things happened. In fact, I'm the one who called safety to report that they were terminating me for something I didn't do.

you do not have to spread a rumor about yourself on here. we do not need to know what you are accused of. most states do not require a reason for termination. I understand someone not wanting to type a long post about why they maybe were terminated, cause then the conversation gets hijacked on what the allegation is, & if your guilty or innocent, & not about your question. good luck.
rockee, raged.ga and Rollinsteady Thank this.
