I received a post card in the mail stating that a settlement has reached the preliminary approval stage in the Brown, et al v JB Hunt Transport, Inc lawsuit [Circuit Court of Cook County, Illinois]. This settlement case is for JB Hunt drivers who had an occurrence in Illinois while using a vehicle equipped with Lytx In-facing camera between the dates of November 8, 2018 to May 4, 2025. The lawsuit alleges that the Illinois Biometric Information Privacy Act ("BIPA"), 740 ILCS 14/1, et seq., prohibits private companies from capturing, obtaining, and/or disclosing biometric identifiers and/or biometric information, alleged to include scans of facial geometry, of an individual without first providing such individual with certain written disclosures and obtaining written consent. If the settlement is approved by the court, a total amount of 976,276.00 will be established to pay all the claims. Every class member will be entitled to $135.00.
