No I wasn't saying that, you cannot deduct the whole perdiem twice, just the balance,if company gives you 40.00per day,at the end of the year at tax time you can deduct 12.00 for each day out which gives you your whole 52. the company takes the hit, now if a company does not give any perdiem you can at the end of the year claim perdiem, but you only get 39.00 this way,you only get 3/4ths of the 52.00. The tax accountant did say don't try to get 52..00 at the end of the year if your company gave you perdiem,he did say on the company tax sheet it has code letters and tell irs that they give perdiem, all you can legally do is get the difference. Be sure to have a reliable accountant do your taxes that has plenty of experience with trucks. You won't imagine the deductions that you have missed thru the years and how fast things change. good luck. I have never been told that I had to take perdiem, but always have as it saves me alot at the end of the year. for instance, tax man told me a long time ago, take the perdiem that the company offers you,you are not taxed on that money every week,it comes off the top like company health insurance and loers your tax and you get more take home. The other way with no company perdiem you are paying taxes.and ssi,and state tax and medicare every week on that money.at the end of the year you get about a third of 52.00because all year you were taxed on that money. The other way you get all 52.00 with no taxes at the end of the year. Hope that helps you.

Dstockwell your statement was correct. if your company does not deduct or give you per diem,at the end of the year you deduct52.00 a day for usa,and 58 per day for travel in canada, even if you are us citizen, irs uses your log book and if audited they accept your logs for proof of perdiem deductions. add up the total whole days out and add up the half days out, i ussually end up about 270 days a year. your accountant will do all this for you,but he likes you to know how much days you can prove.

I told him my situation. About just being fired by Swift during training. I told him what happened and he told me to sue the crap out of them if my DAC report is negitive. I thought it was kind of funny.

How can I find out what Swift has put on my DAC report?

Thanks for the info... I had looked a couple company websites and none of the companies showed or mention per diem, so I am not sure if that something you ask later.

Hey that is a good account. I did target dedicated for them and made good money. Jb does suck but the dedicated runs are the way to go. They seem to suck a little less. I worked for them for a year .

I worked for them for a year. I had a dedicated run for target. I made really good money and thought the company was ok at best. My biggest complaint with them was i was always in trouble for overspeed. My truck did 61 and the speed limit is 65/70. It made no sense and nobody could explain it to me. I got wrote up twice for this. Wait i recant my earlier words...jb does suck.

Thats where good folks like OOIDA come in,if enough drivers get together and they,jb has been doing anything illegal you can all get together with a class action suit. You won't get alot of money but great satisfaction. I told a recruiter 3 weeks ago from them when they called me on my cell phone. i told them I and my wife said stop calling us two yrs ago, they never stopped until i told her that my lawyer will back charge all my voicemails and minutes that i had to pay sprint back to jb. they haven't called in 3 weeks thk God.

Good luck with socialist security, any loans, unemployment, workman's comp, disability or 401(k) or anything that pays based on W2 earnings.
