Just wondering....eld question

    Driving a CMV at the direction of the motor carrier. Sounds like he still falls under FMCSA to me. They have made very plain they don't care about pay and employment relates to pay.

    Which brings up another point. Can he legally even drive the truck? I'm thinking insurance, drug pool and such.

    Under load or not doesn't matter for PC, being told to move at the direction of the motor carrier does matter though.

    Specifically these examples.
    Examples of Uses of a CMV that Would Not Qualify as Personal Conveyance

    Continuation of a CMV trip in interstate commerce in order to fulfill a business purpose, including bobtailing or operating with an empty trailer in order to retrieve another load or repositioning a CMV (tractor or trailer) at the direction of the motor carrier.

    Time spent traveling to a motor carrier’s terminal after loading or unloading from a shipper or a receiver.

    When you spoke to them over the phone when they told you you were fired, did they give you any instructions on what to do with the equipment?

    Yes he said to return truck and trailer to the lot where I picked it up and that is also where my personal car is parked while I'm on the road. He also instructed me to make sure I get all my belongings out and to let him know when I'm getting close to this destination. Oh and to also drive safe...which has never been a big concern of his before. Maybe hes thinking that im gonna tear up his truck...lol

    Make sure you take lots of pictures, inside and out, to cover yourself if they try to claim damage done to the truck.
