Yes, and you can get huge fines if you are caught running red fuel.

I asked a officer about this before. He said if he stuck the tank and it was red, you were getting a ticket. It would be up to you to plead your case in court to prove the red color was something besides untaxed fuel.

I've seen IRS agents at scales checking tanks and at the rack where I load making sure the dyed fuel has the right level of dye in it but I've never met anyone in law enforcement that could tell dyed dsl from kool aid

A few years ago, they got pretty hard on it here in TN. They stopped by our shop and checked everything and even set up roadblocks and only stopped diesel vehicles. It's a TN Department of Revenue officer that goes around checking for it. They use a clear piece of hose, stick it in the tank, put their finger over the end, and pull the fuel up. If the straw is red, you're in trouble.

Farmers and construction outfits are the worst offenders and are targeted most. They have both types of diesel readily on hand and it's awfully tempting to fill the truck up out of the red tank and save about 50 cents on the gallon.

I've tried it on old early 70"s cars, however I wouldn't do it on these new "electronic engines, with their converter and sensors,Def and SAR systems, fuel injectors, turbos.Probably turn them into a Paperweight, real quick.
